The Ministry of Public Security and the Ministry of Justice have just held a signing ceremony for a cooperation program between the two ministries on providing direct legal aid in criminal investigations.
Speaking at the ceremony, a representative of the Legal Aid Department (Ministry of Justice) shared the need to develop a coordination program on direct legal aid in criminal investigations. Because currently the Criminal Procedure Code and the Law on Temporary Detention and Imprisonment have many new regulations on ensuring the right to legal aid.
In addition, the Law on Legal Aid also stipulates the responsibility of the agencies conducting the proceedings to coordinate and create conditions for people receiving legal aid to enjoy the right to legal aid, and create conditions for people providing legal aid to participate in the proceedings.
General To Lam, Minister of Public Security
The Legal Aid Department has coordinated with the Department of Legislation and Administrative and Judicial Reform (Ministry of Public Security) to develop a coordination program on direct legal aid in criminal investigations to enhance coordination in creating conditions for people receiving legal aid to know and use the service promptly at the early stages of the criminal proceedings.
The basic contents of the draft program include the scope of implementation, on-duty form, implementing personnel, mechanism for receiving requests for legal aid and the duties of on-duty personnel, on-duty support personnel, and responsibilities of implementing agencies and organizations.
According to General To Lam, Minister of Public Security, the signing of the program of coordination in providing direct legal aid in criminal investigations has demonstrated the increasingly close and practical coordination of the two ministries in creating maximum favorable conditions for people receiving legal aid.
The early participation of legal aid officers in the investigation of criminal cases helps the accused and the person being prosecuted feel more secure, understand their rights and obligations, and helps investigators investigate the case objectively and quickly.
Minister of Justice Le Thanh Long
Minister of Justice Le Thanh Long added that the number of legal aid cases transferred by police investigation agencies at all levels to the Legal Aid Center has increased year by year. The Minister hopes to continue to receive the attention and close coordination of the Ministry of Public Security in guiding and directing the police at all levels to coordinate with the Department of Justice of provinces and centrally-run cities to fully implement the work in this coordination program.
The program is implemented in all State Legal Aid Centers and the entire system of police investigation agencies, police agencies assigned to conduct certain investigation activities, the system of detention facilities under the people's police, and police of communes, wards and towns nationwide.
