The General Department of Customs has just sent a document to the Customs Departments of provinces and cities to direct the inspection, supervision and handling of shipments that are past the customs clearance deadline.
In order to strengthen customs management and supervision of exported and imported goods brought into, stored, and brought out of ports, warehouses, and yards, to combat and prevent smuggling and trade fraud, on October 30, 2024, the General Department of Customs issued Document No. 5294/TCHQ-GSQL. Send to the Customs Department of provinces and cities to request the performance of a number of tasks.
Accordingly, regarding the inspection, supervision and handling of shipments that are past the customs clearance deadline, the General Department of Customs requests the Customs Departments of provinces and cities to perform the following:
For goods stored from 30 to 90 days at warehouses, ports, and yards: For imported shipments that have not gone through customs procedures, the Head of the Customs Branch where the goods are stored shall base on the information on the Goods Manifest and other sources of information (if any) to analyze, assess risks and apply screening inspection or apply appropriate control measures to shipments with signs of violations and high risks; update screening results on the System (if any). When an enterprise registers a declaration, the Head of the Customs Branch where the declaration is registered shall base on the results of the flow on the system, customs records, signs of violations, signs of risks, screening results (if any) to decide to conduct a physical inspection of the goods, handle violations (if any) and resolve customs procedures according to regulations.

For goods stored for more than 90 days at warehouses, ports, and yards: Periodically on the 15th of each month, the Customs Sub-Department where the goods are stored shall conduct statistics, review, and look up data on goods arriving at ports, warehouses, and yards for more than 90 days on the system but have not yet completed customs procedures, and compare them with data monitored by port, warehouse, and yard business enterprises to determine data on goods stored for more than 90 days and backlogged goods. In case no one comes to receive the goods after 90 days, the Customs Branch where the goods are stored shall notify the owner of the goods according to the provisions of Article 8, Circular No. 203/2014/TT-BTC dated December 22, 2014 of the Ministry of Finance and handle as follows: Within the time limit for notification of finding the owner of the goods, if someone comes to receive the goods and registers the declaration, the Customs Branch where the goods are stored shall be equipped with a scanner to perform the scanning and update the scanning results on the System (except for cases where the shipment has been scanned and cases where the goods are not suitable for inspection via the scanner according to Decision 2056/QD-TCHQ dated August 29, 2024 of the General Department of Customs). In case there is no scanner and the goods are transferred to an inspection location outside the border gate, the Customs Branch where the goods are stored shall hand over the goods (including information about the goods that have not been scanned) to the Customs Branch where the declaration is registered to transfer the actual inspection channel; Monitor, handle violations (if any) and continue to resolve customs procedures according to regulations.
In case the deadline for notification to find the owner of the goods has passed and no one comes to receive the goods, the Customs Branch where the goods are stored shall report to the Director of the Provincial or Municipal Customs Department to decide to establish a Council for handling backlogged goods to conduct inventory and classify backlogged goods according to the provisions of Article 12, Circular 203/2014/TT-BTC.
