Continuing the ninth extraordinary session: The National Assembly discussed in groups draft laws and resolutions

Continuing the agenda of the ninth extraordinary session, on the morning of February 13, National Assembly deputies discussed in groups: the draft Law on Government Organization (amended); the draft Law on Local Government Organization (amended) and the draft Resolution of the National Assembly regulating the handling of a number of issues related to the reorganization of the state apparatus.

Comrade Ngo Dong Hai, member of the Party Central Committee, Deputy Head of the Central Propaganda and Mass Mobilization Commission, spoke at the discussion at Group 19.

Comrade Nguyen Khac Dinh, member of the Party Central Committee, Vice Chairman of the National Assembly; Comrade Ngo Dong Hai, member of the Party Central Committee, Deputy Head of the Central Propaganda and Mass Mobilization Commission and National Assembly deputies of Thai Binh province participated in the discussion at Group 19, including National Assembly delegations of Thai Binh, Nam Dinh and Binh Duong provinces.

National Assembly deputies discussed and commented that the regulations related to the issue of decentralization, decentralization, delegation of authority, and authorization in the draft Law on Organization of the Government (amended) and the draft Law on Organization of Local Government (amended) although they are new regulations, have been drawn from and summarized from past practices and there are things that have been done in the past and current practices require clear regulations in the law...

The draft laws submitted to the National Assembly at this session have more clearly demonstrated what decentralization, delegation of authority, and delegation of authority are. Accordingly, Clause 1, Article 7 of the draft Law on Organization of the Government (amended) stipulates that "Decentralization is the regulation of the tasks and powers of the Government, the Prime Minister, and local authorities in the law, ensuring compliance with the principle of delimitation of authority in this Law and the Law on Organization of Local Government"; Clause 5, Article 6 of the draft Law on Organization of the Government (amended) clearly states that the Prime Minister is the head of the Government; leads the work of the Government and is responsible to the National Assembly for the activities of the Government and assigned tasks, ensuring the principle of not deciding on specific issues under the responsibility of the Minister, Head of a ministerial-level agency as a member of the Government for the assigned sector or field. Also according to the draft Law on Organization of the Government (amended), decentralization must be stipulated in the legal documents of the decentralizing agency or person. The decentralizing agency or person is responsible for ensuring the necessary conditions when deciding on decentralization.

Similarly, the draft Law on Organization of Local Government (amended) also has a separate chapter, specifically regulating the direction of expanding the scope of subjects being decentralized, authorized and objects receiving decentralized, authorized; more clearly regulating the requirements on responsibilities from both sides in decentralization and authorization.

Delegates also assessed that it is necessary to continue to improve regulations on decentralization and delegation of authority to local authorities in order to concretize the policy of promoting decentralization and delegation of authority, promoting the initiative, creativity and self-responsibility of local authorities at all levels. However, because this content is related to many other laws in the legal system, delegates suggested that the drafting agency should continue to review to ensure consistency between the provisions of the draft Law and relevant provisions in the draft Law on Organization of the Government (amended) on how to stipulate principles on the division of authority, decentralization, delegation and delegation as well as ensuring consistency and transparency in terms of subjects of decentralization and delegation, objects receiving decentralization and delegation, methods and conditions for ensuring implementation.

In the afternoon, the National Assembly held a plenary session in the hall to listen to the presentation of the proposals and appraisal reports on the investment policy of the Lao Cai - Hanoi - Hai Phong railway project; the proposal and appraisal report on the draft Resolution on piloting a number of specific and special mechanisms and policies to develop the urban railway network system in Hanoi and Ho Chi Minh City. Next, the National Assembly deputies discussed in the hall the draft Law on Promulgation of Legal Documents (amended).
