
The Draft Regulation detailing a number of contents on land allocation limits; land allocation and lease areas; residential land recognition limits; agricultural land use right transfer transfer limits; conditions and minimum areas for land division and land consolidation for each type of land in Dien Bien province consists of 3 chapters and 17 articles. This regulation is based on the provisions of Clause 5, Article 16, Clause 4, Article 139, Clause 5, Article 141, Clause 5, Article 176, Clause 3, Article 177, Clause 2, Article 195, Clause 2, Article 196, Clause 4, Article 213, Clause 4, Article 220 of the 2024 Land Law.
Delegates from districts, towns and cities focused their opinions on difficulties and obstacles in implementing land allocation and granting land use right certificates in localities such as: Area of land allocation and land lease for ethnic minorities; limits on agricultural land allocation for households and individuals; limits on land use right transfer; minimum limits allowed for land division, etc.
Regarding the detailed regulations on a number of contents on compensation, support and resettlement when the State acquires land in Dien Bien province, the draft regulation has 22 articles. The regulation is developed based on the provisions of Article 104, Clause 5, Article 109, Clause 7 and Clause 10, Article 111 of the Land Law No. 31/2024/QH15; Decree No. 88/2024/ND-CP dated July 15, 2024 of the Government on compensation, support and resettlement when the State acquires land.

Comments focused on: Plans for handling remaining residential land areas when the State reclaims land that is not suitable for residence; remaining agricultural land areas that cannot be cultivated; compensation for damage to houses and other construction works attached to the land when carrying out site clearance. Compensation levels for cases where the land use purpose is not changed but the right to use is restricted...
Agreeing with the above content, Chairman of the Provincial People's Committee Le Thanh Do proposed: Regarding land limits, the Department of Natural Resources and Environment should review the minimum limit on recognizing land use limits for cases before 1980. For areas of land for perennial crops, production land, and protective forest land, it is necessary to divide each specific content between wards, towns, and communes.

Regarding the resettlement compensation, the Department of Natural Resources and Environment needs to pay attention to the remaining residential land area after the State recovers the land that is not large enough for residence; the agricultural land area when recovered is not large enough for cultivation, it is necessary to consider options for transfer, recovery, and support. At the same time, research and supplement regulations on compensation levels for cases where the land use limit is not changed but the right to use is restricted in the easiest way to implement. The Department of Natural Resources and Environment will complete the submission to the Provincial People's Committee before October 25.
In addition to the contents discussed directly at the meeting, there are 8 contents (of which 6 contents are in the field of construction submitted by the Department of Construction; 1 content submitted by the Department of Finance and 1 content submitted by the Department of Labor - Invalids and Social Affairs), the Provincial People's Committee sent a ballot to ask for opinions from the committee members.
