Kinhtedothi - At the 7th Conference of specialized National Assembly deputies on March 25, National Assembly deputies discussed the Draft Law amending and supplementing a number of articles of the Law on Technical Standards and Regulations.


Discussing at the conference, National Assembly delegate Le Huu Tri (Khanh Hoa Provincial Delegation) proposed adding Article 26a after Article 26 of the Law on Technical Standards and Regulations, regulating the content of criteria to determine the scope of developing national technical regulations and local technical regulations.

According to the delegate, there are currently many products that are local specialties but do not have specific standards. Group 2 products do not have standards in Vietnam, leading to many difficulties in quality management according to legal documents. In fact, there are many local specialties that are exported to many other countries in the world, but if we want to develop Vietnamese standards, there are no standards; if we want to develop local standards, the competent authority has not yet approved the development of local standards, so it is very difficult to create competitive advantages for local products.

Delegate Le Huu Tri also stated that Clause 2, Article 45 and Clause 2, Article 48 of the Law on Technical Standards and Regulations stipulate that "Organizations and individuals declaring conformity to standards and regulations must register the declaration of conformity to standards and regulations with competent State agencies". However, in the process of implementing the reception of registration of declarations of conformity to standards and regulations of organizations and individuals, it is shown that the regulation requiring registration of the declaration in cases where organizations and individuals declare based on the results of certification of conformity with the designated certification organization or registered for operation is unnecessary, causing effort and additional costs.

The delegate suggested that if the contract for declaration of conformity and conformity is still maintained, the drafting agency should study and amend and supplement the regulations in the direction that organizations and individuals declaring conformity and conformity based on the results of conformity certification by the certification organization do not have to register the declaration with the competent State agency, and only stipulate that organizations and individuals declaring conformity and conformity based on their own self-assessment results must register the declaration with the competent State agency.

National Assembly Delegate Nguyen Minh Tam (Quang Binh Province Delegation) suggested that the Drafting Committee study and clearly define responsibilities and powers so that the National Technical Standards Board can work better and also have more transparent standards.

Regarding the content of the regulation on the establishment and publication of basic standards in Clause 15, amended and supplemented Article 20, delegate Minh Tam suggested that the Drafting Committee study and supplement the validity period of the basic standards announcement table and stipulate that enterprises must publicly post it at the place of production and business.

Receiving the opinions of National Assembly deputies, Minister of Science and Technology Nguyen Manh Hung emphasized that some important points of amendment in the Law on Standards and Technical Regulations this time are amending regulations to ensure compliance with international commitments, especially new-generation FTAs, and supplementing regulations to promote socialization in the development of standards, regulations, certification and inspection activities. Promoting the role of enterprises and associations in the development of standards and regulations; perfecting the processes of developing standards and regulations, especially regulations on impact assessment when developing national standards. Regulating the role of the Ministry of Science and Technology in inspecting and evaluating the development and application of regulations in Vietnam.

Regarding improving the capacity to develop standards at the local level, Minister Nguyen Manh Hung said that currently, some localities are doing very well, while others are not doing well, and the drafting committee will take this opinion into account.
