DNO - On September 9, in Da Nang, the Ministry of Planning and Investment held a workshop to collect opinions from provinces and cities in the North Central and Central Coast regions and the Central Highlands on the draft Law on Public Investment (amended) and the Law amending and supplementing a number of articles of the Law on Planning, the Law on Investment, the Law on Investment under the public-private partnership model, and the Law on Bidding.

The Ministry of Planning and Investment said that after 5 years of implementing the 2019 Law on Public Investment, a number of difficulties and problems have been revealed that need to be handled and resolved; some regulations are not suitable to the practical situation and development requirements in the new situation.
At the same time, some new pilot mechanisms and policies in some provinces and cities agreed by the National Assembly need to be studied to be institutionalized in law.
Implementing the direction of the Government and the Prime Minister, the Ministry of Planning and Investment has urgently presided over and coordinated with ministries, central and local agencies to develop relevant documents, report to the Government to submit to the National Assembly Standing Committee for permission to add to the 2024 Law and Ordinance Development Program, and submit to the National Assembly for permission to apply the shortened procedures for consideration and approval at the next session.
The Ministry of Planning and Investment has proactively drafted the Law on Public Investment (amended), including 29 new policies, and sent it to ministries, central and local agencies for comments; at the same time, organized conferences and seminars to collect comments from representatives of provincial and municipal People's Committees, departments, boards (project management boards, economic zone management boards, etc.), and sectors to complete the law.

Speaking at the workshop, Deputy Minister of Planning and Investment Tran Quoc Phuong informed about 5 main policy groups being amended in the draft Law on Public Investment, such as: institutionalizing pilot and specific mechanisms and policies that have been allowed by the National Assembly to be applied in a number of localities.
For example, the National Assembly allows Da Nang city to separate compensation, support, resettlement, and site clearance projects from public investment projects in group B; continue to promote decentralization and delegation of authority; improve the quality of investment preparation, resource exploitation, and capacity to implement public investment projects of localities and state-owned enterprises; promote the implementation and disbursement of ODA capital plans and preferential loans from foreign donors; simplify procedures; supplement and clarify concepts, terms, and regulations, ensuring consistency and uniformity of the legal system...
This amendment to the Law on Public Investment is very comprehensive, with urgent progress and high quality requirements to fundamentally overcome difficulties, limitations, obstacles, and bottlenecks, improve the efficiency of capital use, and unlock resources for development.

Participating in the workshop, Vice Chairman of the People's Committee of Da Nang City Tran Chi Cuong basically agreed with the amendments in the draft Law on Public Investment and expressed his hope that if approved by the upcoming session of the National Assembly, it will remove many difficulties and obstacles for localities in deploying and implementing investment projects.
For example, along with Da Nang and a number of provinces and cities being allowed by the National Assembly to separate compensation, support, resettlement, and site clearance projects from public investment projects in Group B, the draft Law on Public Investment has proposed to apply more public investment projects in Group B and C; the draft law has proposed to increase the transitional capital ratio to 50% (the 2019 Law on Public Investment is 20%) when building and planning medium-term public investment capital...
Vice Chairman of the City People's Committee Tran Chi Cuong also proposed to study and add more specialized agencies to prepare project investment policy reports depending on the specific characteristics of the project to be flexible and effective, instead of just assigning this task to the project management board; review current regulations and further study the regulations on decentralization of responsibilities between individuals (individual) and collectives (general) to avoid overlap and comply with the Law on Organization of Local Government...
