BTO-This afternoon, May 27, Member of the Party Central Committee - Secretary of the Provincial Party Committee - Head of the National Assembly Delegation of Binh Thuan Province Duong Van An chaired the discussion at Group 14 on the Draft Law amending and supplementing a number of articles of the Law on People's Public Security (CAND); Draft Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit, and Residence of Foreigners in Vietnam.
Also participating in the discussion at Group 14 were the National Assembly Delegations of Son La and Hai Duong provinces.
Speaking at the discussion session, Member of the Party Central Committee - Secretary of the Provincial Party Committee - Head of the National Assembly Delegation of Binh Thuan Province Duong Van An said: The development of the draft Law amending and supplementing a number of articles of the Law on Public Security to institutionalize the Party's guidelines and policies, remove difficulties and obstacles, ensure the consistency and unity of the legal system, meet the requirements of protecting national security, ensuring social order and safety is necessary. National Assembly Deputy Duong Van An suggested a number of issues for delegates to focus on discussing such as: The necessity of promulgating the Law; the proposed contents of amendments and supplements include: Regulations on the time limit for considering promotion from Colonel to Major General; Regulations on criteria and standards for making outstanding achievements to consider promotion from General to General before the deadline; Supplementing regulations on the highest rank for a number of positions and titles of People's Public Security officers; The highest age limit for serving officers, non-commissioned officers, and public security workers...
Regarding the Draft Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam, National Assembly Deputy Duong Van An suggested that National Assembly Deputies discuss the necessity of promulgating the Law; Proposed amendments and supplements include: Entry and exit documents and information on entry and exit documents (Clause 1, Article 1 of the draft Law); issuance of domestic ordinary passports (Clause 3, Article 1 of the draft Law); cases of revocation and cancellation of passport validity, cancellation of ordinary passport validity (Clause 7 and Clause 8, Article 1 of the draft Law); visa validity (Clause 1 and Clause 2, Article 2 of the draft Law); expansion of scope and conditions for granting electronic visas (Clause 3, Article 2 of the draft Law); regulations on temporary residence declaration (Clause 5 and Clause 8, Article 2 of the draft Law)...
Discussing the Draft Law amending and supplementing a number of articles of the Law on Public Security; Provincial National Assembly Deputy Dang Hong Sy said that the current number of generals in the Public Security sector is 199 generals. According to the announcement of the Politburo, the maximum number is allowed to be 205, an increase of 6 generals; this number is suitable and guaranteed according to the conclusion of the Politburo. However, for the newly established unit decided by the National Assembly Standing Committee, it is expected to increase to 206 generals. This should be considered and recalculated, because if implemented as in the draft law, is it suitable according to the conclusion of the Politburo?
Regarding the increase in the age limit for service in the People's Public Security, delegate Dang Hong Sy basically agreed with the roadmap. However, for non-commissioned officers serving under the age of 60, the age limit should be increased by 2 years at once (from 45 to 47 years old), as this force is very large. According to delegate Dang Hong Sy, it should be implemented according to the roadmap of the Labor Code, which generally stipulates 1 year and 3 months for men; 1 year and 4 months for women...
Comments on the Draft Law amending and supplementing a number of articles of the Law on Exit and Entry of Vietnamese Citizens and the Law on Entry, Exit, Transit and Residence of Foreigners in Vietnam; Provincial National Assembly Delegate Pham Thi Hong Yen commented on Clause 2, Article 33 on temporary residence declaration of foreigners. The delegate said that this provision should be kept open. Specifically, tourist accommodation establishments must declare temporary residence for foreigners via the electronic environment or temporary residence declaration form; there should not be a prescribed method via the electronic environment. Currently, many 1-star hotels are not qualified to declare in the electronic environment, making it difficult to comply with the provisions of the law.
Also giving opinions on this draft law, Provincial National Assembly Delegate Tran Hong Nguyen was interested in Point B, Clause 2, Article 15. The delegate suggested that for people who have lost civil capacity, people with difficulty in cognition and behavior control according to the provisions of the Civil Law, people under 14 years old, it is necessary to add people with disabilities... For these people, it would be more appropriate to allow their legal representatives to carry out administrative procedures...
