On the morning of May 27, continuing the program of the 5th Session, the National Assembly held a plenary session in the hall to listen to the draft Law amending and supplementing a number of articles of the Law on People's Public Security.
Extending the service age in the People's Public Security
At the meeting, reporting on the draft Law amending and supplementing a number of articles of the Law on the People's Public Security, General To Lam, Minister of Public Security, emphasized the need to promulgate the law to ensure consistency and synchronization with regulations on increasing the retirement age of employees; overcome a number of difficulties and obstacles in the implementation of the Law on the People's Public Security related to early promotion to the rank of general for People's Public Security officers with outstanding achievements in combat and work; and specify a number of positions with the rank of general in the People's Public Security in accordance with Party regulations and work requirements.

Minister of Public Security To Lam talked about some amendments and supplements in this draft law.
Specifically, the bill stipulates that a People's Public Security officer who is considered for promotion from Colonel to Major General must have at least 3 years of service remaining. In cases where the remaining 3 years of service are not sufficient, the President will decide.
The draft law also adds the following direction: The Government shall specify the criteria and standards for early promotion to the rank of general for People's Public Security officers with outstanding achievements in combat and work. This content addition aims to specifically define the criteria and standards for outstanding achievements in combat and work as a basis for proposing the President to consider and decide on early promotion to the rank of general.
Along with that, the bill also adds specific regulations on 6 positions with the highest rank of General in the People's Public Security, including: 1 position with the highest rank of Senior Lieutenant General and 5 positions with the highest rank of Major General; stipulates that the Chief of City Police of a centrally-run city and Regiment Commander have the highest rank of Colonel.
In particular, the bill supplements regulations and increases the maximum service age of police officers (men increase by 2 years, women increase by 5 years); increases the age of officers and non-commissioned officers by 2 years; female officers with the rank of Colonel increase by 5 years, female officers with the rank of Lieutenant Colonel increase by 3 years; female general officers will still maintain the current age of 60 years; and supplements regulations to extend the maximum service age for People's Public Security officers in special cases.
Age increase time according to the roadmap: Each year, increase 3 months for men and 4 months for women. For officers and non-commissioned officers with the highest service age under 60 years old for men and under 55 years old for women, the age increase is 2 years immediately, not following the above roadmap.
The time for increasing the maximum service age will start from 2021 but will not apply to cases that have retired from work before the effective date of this law. The Government shall specify the roadmap for increasing the maximum service age of police officers, non-commissioned officers, and workers in accordance with the provisions of the Labor Code.
The bill also extends the service age for People's Public Security officers who are professors, associate professors, doctors, and senior experts from 60 to 62 years old for men; from 55 to 60 years old for women...
Reviewing basic conditions for early promotion to general rank
Representative of the agency examining the draft law, Chairman of the National Assembly's Committee for National Defense and Security Le Tan Toi agreed with the necessity of promulgating the Law amending and supplementing a number of articles of the Law on People's Public Security; said that amending a number of provisions of the 2018 Law on People's Public Security at the present time is necessary, in order to institutionalize the Party's viewpoints and directions on promoting the building of a truly clean, strong, disciplined, elite, and modern People's Public Security force to meet the requirements and tasks in the new situation.

The amendment and supplementation of a number of articles of the Law on the People's Public Security also aims to continue to perfect the law on the People's Public Security, implement the regime and policies for the People's Public Security force; ensure consistency and synchronization with the provisions of the Labor Code on the retirement age of employees; overcome a number of difficulties and problems arising in the practical work and combat of the People's Public Security force to meet the requirements of tasks in the new situation.
The majority of opinions in the National Defense and Security Committee believe that the provisions in the draft law are consistent with the Party's policies and guidelines, the provisions of the 2013 Constitution, and basically ensure feasibility and ensure the correlation of working age as prescribed in the Labor Code.
At the same time, it is recommended to continue reviewing regulations on extending the maximum service age, regulations on regimes and policies related to the Labor Code and the Social Insurance Law to ensure consistency...
The Ministry of National Defense will review and propose amendments and supplements to the Law on Officers of the Vietnam People's Army as appropriate. On the other hand, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi also said that, implementing the direction of the National Assembly's leaders, on December 16, 2022, the Committee on National Defense and Security sent a document requesting the Ministry of National Defense to discuss the expected time and content of the proposal to amend and supplement the Law on Officers of the Vietnam People's Army. On December 22, 2022, the Ministry of National Defense responded in writing to the National Defense and Security Committee, stating that based on the summary results and roadmap for implementing Resolution No. 05-NQ/TW dated January 17, 2022 of the Politburo on the organization of the Vietnam People's Army for the 2021-2030 period and the following years; the Ministry of National Defense will consider and propose amendments and supplements to the Law on Officers of the Vietnam People's Army as appropriate. |
