This Law comes into force from August 15, 2023.

This Law stipulates the maximum service age of non-commissioned officers and officers of the People's Public Security as follows:

- Non-commissioned officers: 47;

- Lieutenant: 55;

- Major, Lieutenant Colonel: Male 57, female 55;

- Lieutenant Colonel: Male 60, female 58;

- Colonel: Male 62, female 60;

- General rank: Male 62; female 60.

In case the police unit has a need, if an officer has sufficient qualities, is good at expertise and profession, is in good health and volunteers, his/her service age can be extended according to the regulations of the Minister of Public Security, but not more than 62 for men and 60 for women.

In special cases, the service age may be extended beyond 62 for men and beyond 60 for women according to the decision of the competent authority.

In addition, this Law also specifically stipulates 7 positions with the highest rank of Senior Lieutenant General; 162 positions with the rank of Major General in the People's Public Security.

This law also clearly stipulates: Officers considered for promotion from Colonel to Major General must have at least 3 years of service left; in case they do not have 3 years of service left, upon request, the President will decide...

The Ministry of National Defense is reviewing the Law on Officers of the Vietnam People's Army.

Previously, during the discussion, some delegates proposed to amend and supplement the Law on Officers of the Vietnam People's Army at the same time as this law to ensure correlation.

Elaborating on this content at the meeting, Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi said that the Ministry of Public Security has basically completed the arrangement and streamlining of the organizational apparatus in accordance with the spirit of the Party's Resolutions; and the Ministry of National Defense is summarizing the Law on Officers of the Vietnam People's Army. Based on the results of the summary, it will consider and propose amendments and supplements to the Law on Officers of the Vietnam People's Army as appropriate.

Regarding the opinions proposing regulations to ensure the correlation between the People's Public Security and the People's Army, according to the Chairman of the National Assembly's Committee on National Defense and Security, Le Tan Toi, these two forces have many similar policies, but also many differences in terms of organization, functions, tasks, nature of activities, specific areas and fields. The National Assembly Standing Committee has directed the Committee on National Defense and Security to carefully study these opinions, discuss and reach an agreement with the Ministry of National Defense to adjust the regulations on regimes, policies, service age limits, and highest ranks accordingly.

"For the above reasons, the National Assembly Standing Committee finds that amending and supplementing a number of articles of the Law on People's Public Security at the present time is very necessary, ensuring adequate political, legal and practical bases," said Chairman Le Tan Toi.

Regarding the maximum service age of officers, non-commissioned officers, and police workers, some delegates proposed to regulate the maximum service age of officers and non-commissioned officers in accordance with the nature of the armed forces and the specific characteristics of each force and unit.

Clarifying the above content, Chairman Le Tan Toi stated: The regulations on the highest service age of officers, non-commissioned officers, and police workers in the draft law have been carefully studied and evaluated on the basis of institutionalizing the Party and State's guiding views on adjusting the retirement age and reforming social insurance policies; inheriting the provisions of the 2018 Law on the People's Public Security on the highest service age; in accordance with the provisions of the Labor Code on the retirement age of employees, while ensuring compliance with the practical working and combat conditions of each position and rank in the People's Public Security.

"Based on the regulations on the highest service age for each rank, the Minister of Public Security will prescribe the service age for positions and titles in accordance with the specific nature of each force, unit and the specific position, area and field of work of each individual," said Le Tan Toi, Chairman of the National Assembly's Committee on National Defense and Security.
