On the morning of September 21, the Government Standing Committee held a national online conference to collect opinions on the draft report of the Government on the results of the review of the system of legal documents (QPPL) according to Resolution No. 101/2023/QH15 of the National Assembly (Resolution No. 101). The Government reviews all legal documents in 22 key areas.
At the conference, Minister of Justice Le Thanh Long reported the results of the review of the system of legal documents according to Resolution No. 101. Accordingly, the Government has organized a review of all legal documents in 22 key areas and a number of other areas with recommendations and proposals.
The total number of legal documents reviewed was 397, including 60 laws and resolutions of the National Assembly, 139 decrees of the Government and decisions of the Prime Minister, and 198 other documents issued by central agencies. The review showed that there were 16 conflicting and overlapping documents; 93 documents had inappropriate or problematic provisions; 1 law (Land Law) with 6 contents had "loophole" provisions.
Regarding the recommended and proposed documents, there are 5 documents in the fields of land and environment with inappropriate and problematic regulations.

The conference also proposed solutions to overcome overlaps and contradictions. At the same time, it was proposed that the competent authority to issue legal documents should propose the handling of conflicting and overlapping contents and determine a specific roadmap for the time of handling; thoroughly grasp and strictly implement regulations on the development, inspection and review of legal documents; strengthen the examination and supervision of the National Assembly and its committees in the development and implementation of laws; increase the quality and quantity of the staff working on law making...

Participating in the discussion at the conference, Permanent Vice Chairman of the Provincial People's Committee Nguyen Hong Linh said: The People's Committee of Ha Tinh province has directed provincial departments, branches and localities in the area to review legal documents. The Standing Vice Chairman of the Provincial People's Committee said that Ha Tinh is currently facing difficulties in approving investment policies; the auction sector still faces many contradictions and overlaps. Therefore, it is recommended that the Government should soon add this content to the auction sector to have appropriate amendments and supplements. Propose to resolve some difficulties in Circular No. 25/2022 dated December 30, 2022 of the Ministry of Agriculture and Rural Development regulating replacement forest planting when converting forest use to other purposes. In particular, priority is given to completely resolving shortcomings that affect key projects such as the North-South Expressway, the national power line project, etc.
The Standing Vice Chairman of the Provincial People's Committee also proposed that competent authorities at the Central level, when assigning detailed regulations to the People's Council and People's Committee, must be clear and specific, avoiding generalities that cause difficulties for localities in the process of drafting legal documents.
Concluding the conference, Deputy Prime Minister Le Minh Khai highly appreciated the ministries, branches and localities for reviewing legal documents, which served as a basis for drafting a report summarizing the Government's review results. The Deputy Prime Minister requested that ministries, branches and localities continue to review problems within their authority, thereby proposing and proposing amendments and handling overlapping and contradictory contents to ensure quality and effectiveness.
