Along with the heads of the General Department of Politics of the Vietnam People's Army, the General Staff of the Vietnam People's Army and nearly 400 delegates from agencies and units inside and outside the Army.

In the process of implementing the Law on Officers, there are problems and shortcomings.

The Law on Officers of the Vietnam People's Army in 1999 was passed by the 10th National Assembly at the 6th Session on December 21, 1999, effective from April 1, 2000 and amended and supplemented in 2008 and 2014.

Over the past 10 years, implementing the Law on Officers of the Vietnam People's Army (amended), the Central Military Commission and the Ministry of National Defense have regularly paid attention to leading, directing, thoroughly grasping, and organizing the serious and synchronous implementation of the Law on Officers and sub-law documents; have had many forms and measures of propaganda, dissemination and education for officers and soldiers throughout the army and proactively coordinated propaganda and dissemination to all levels, sectors and people to raise awareness and sense of law compliance.

Party committees and commanders of agencies and units have researched, applied, concretized, and organized the synchronous and unified implementation of legal regulations on officers with the Party's resolutions, directives, and regulations on personnel work and cadres.

Ministries, ministerial-level agencies, government agencies and local authorities, within their scope of responsibility, have closely coordinated with the Ministry of National Defense to effectively perform the task of state management of officers; to effectively carry out career guidance and propaganda work, create sources for officer training, improve qualifications, receive transfers and ensure policies and regimes for active officers, officers who have retired from active service and the military rear, and to build a contingent of officers with numbers according to the staffing needs and increasingly high quality, meeting the requirements of tasks in the new situation.

Compared to 2014, the quantity and quality of the current officer corps have been increased, and the structure has been adjusted accordingly. Specifically: The number of officers has reached 100% of the staffing requirement; officers with postgraduate qualifications have increased by 5.39%; the proportion of female officers and ethnic minority officers has increased. Many comrades have been assigned and mobilized by competent authorities to hold leadership positions in the political system from the central to local levels and have directly worked and continuously operated in the international environment (participating in the United Nations peacekeeping force, doing foreign affairs work, being defense attachés, etc.).

After nearly 10 years of implementation, the Law on Officers has created motivation for officers to strive to fulfill their assigned duties and tasks, truly being the core in building a revolutionary, disciplined, elite, and gradually modern Vietnam People's Army, contributing to building and firmly protecting the socialist Vietnamese Fatherland.

However, in the process of implementing the Law on Officers, there have been problems and shortcomings, such as: Officer positions; age of officers in active service; ceiling on general rank; shortening the time limit for consideration of promotion to lieutenant rank; regimes and policies for officers; reserve officers...

Based on the summary at all levels, the Ministry of National Defense proposed that the Government report to the National Assembly Standing Committee to submit to the National Assembly for amendment and supplementation of a number of articles of the Law on Officers of the Vietnam People's Army at the 8th Session of the 15th National Assembly on the basis of inheriting the provisions of the Law on Officers that are still suitable, adjusting new provisions to fundamentally overcome difficulties, inadequacies and new issues arising in practice.

At the conference summarizing the Law on Officers of the Vietnam People's Army (VPA), delegates affirmed the advantages and typical results of the entire army in implementing the Law on Officers; proposed and recommended a number of solutions and unanimously affirmed the necessity to amend and supplement a number of contents of the current law and a number of current legal documents to overcome current difficulties and shortcomings.

Lieutenant General Tran Ngoc Quyen, Political Commissar of the Air Defense - Air Force, suggested: With the characteristics of a technical unit, the staff of the Air Force is very diverse in terms of specialties, with many specialties requiring high-quality human resources, with work experience such as engineers, doctors, pilots or some specialties that military schools have not yet trained such as meteorology, petrochemistry... If they retire according to the current law, it will be very disadvantageous for the officers and a waste of human resources.

To be consistent with the Law on Social Insurance and to maintain the experienced cadres, Lieutenant General Tran Ngoc Quyen proposed to increase the age of active service of officers, specifically: General: 60; Colonel: 58; Lieutenant Colonel: 56; Lieutenant Colonel: 54; Major: 52; Lieutenant: 50. At the same time, there should be policies on housing, salary, allowances; policies to attract and use talents to retain and attract high-quality human resources to the Army.

Meanwhile, Major General Nguyen Duc Hung, Political Commissar of the 12th Corps, proposed amending the Law on Officers to ensure better benefits for officers upon retirement. In fact, in the 12th Corps, the number of officers with the rank of major or lieutenant colonel accounts for more than 40%, and every year, the number of these officers retiring accounts for more than 60% of the total number of retired officers in the entire Corps. Therefore, adjusting this policy will have a positive impact on the performance of current officers' duties.

There are not many mechanisms and policies to attract and promote talents.

In his concluding remarks and direction of the conference, General Phan Van Giang, Politburo member, Deputy Secretary of the Central Military Commission, Minister of National Defense, pointed out: The Central Military Commission, the Ministry of National Defense, Party committees, leaders, and commanders at all levels have led and directed the implementation of the Law on Officers and the documents regulating and guiding its implementation.

The Minister of National Defense also pointed out some limitations in the implementation of the Law such as: The understanding and awareness of some provisions of the Law on Officers and sub-law documents by some Party committees and commanders are not complete and profound; the organization and implementation are not synchronous, with contents not close to the practical situation of the unit. The work of researching, forecasting and assessing the impact of policies in advising and proposing the development of sub-law documents and related documents has contents that are not close to reality, synchronous and not linked to the specific nature and tasks of the Army.

The negative aspects of the market mechanism, the special working environment of the Army, the family circumstances and income of officers today compared to the average level of workers in society with the same level of training have affected the thinking of officers; a small number of officers do not have the consciousness to strive and practice regularly; there are not many mechanisms and policies to attract and use talented people to serve in the Army. Emphasizing this issue, quoting Senior Lieutenant General Nguyen Van Nghia, Deputy Chief of the General Staff of the Vietnam People's Army, Senior General Phan Van Giang said that currently, more than 85% of officers are working in remote, isolated, border and island areas; therefore, there must be special policies to attract talented people to the Army.

In addition, General Phan Van Giang also pointed out that the coordination with a number of ministries, branches and localities in implementing the Law on Officers and related sub-law documents and legal documents at times and with content still remains at a certain level.

Speed ​​up the process of amending the Law on Officers

In the coming time, Minister Phan Van Giang requested Party committees and commanders of agencies and units to continue to thoroughly grasp and seriously implement the Party's viewpoints and guidelines on the work of building a contingent of cadres; strictly comply with principles, regulations, processes and provisions on cadre work; comment and evaluate cadres in conjunction with planning, training, fostering, appointment, rotation, transfer, extension of service term, conferment and promotion of officer ranks, and salary increase of cadres to ensure strict compliance with regulations.

Focus on leading and directing the building of politically strong units, improving the comprehensive leadership capacity and fighting strength of Party committees and organizations at all levels; effectively implementing state management on building the contingent of officers within the scope and authority; being proactive in international cooperation, promoting all resources to build the contingent of officers. Setting high requirements for officers, at the same time creating an environment and working conditions for officers to fulfill their tasks well.

In particular, Minister Phan Van Giang requested relevant agencies to speed up the process of making proposals and submitting to the National Assembly for approval the revised Law on Officers to ensure strictness and efficiency; especially to overcome difficulties and shortcomings in the implementation process; after the law is passed by the National Assembly, it must take effect immediately, contributing to building a contingent of officers to meet the requirements of building the Army, strengthening national defense, and protecting the Fatherland in the new situation.
