Kinhtedothi - On the morning of November 14, at the 39th session, the National Assembly Standing Committee gave opinions on explaining, accepting, and revising the draft Law on Value Added Tax (amended).


Reporting on the explanation, acceptance and revision of the draft Law, Chairman of the National Assembly's Finance and Budget Committee Le Quang Manh said that the National Assembly Standing Committee agreed with the Government's proposal to transfer fertilizers, agricultural machinery and fishing vessels from non-taxable to 5% taxable.

However, during the discussion in the hall of the 8th Session, there were still some National Assembly deputies who did not agree on this content. Therefore, the Standing Committee of the Finance and Budget Committee requested the National Assembly Standing Committee to give instructions on collecting opinions of National Assembly deputies.

Discussion opinions emphasized that although the two reviewing and drafting agencies had reached an agreement, it was still an issue that received attention during discussion, so it was necessary to consult with delegates to provide full information and clarify their concerns to create consensus.

Concluding this content, Vice Chairman of the National Assembly Nguyen Duc Hai emphasized that the National Assembly decides by majority, so it will seek the opinions of National Assembly deputies.

The audit agency also raised 5 issues with different opinions, namely the Regulation on not having to pay output value-added tax but being able to deduct input value-added tax; the level of revenue from the sale of goods and services not subject to value-added tax; products provided on digital platforms are not subject to a 0% tax rate when exported; on a 0% tax rate for groups of goods provided to other foreign organizations and individuals; on no tax refund for cases of imported goods for export.

Specifically, regarding the level of revenue from sales of goods and services not subject to value added tax (Clause 25, Article 5), the Chairman of the Finance and Budget Committee said that the draft after receiving and revising has stipulated a threshold of VND 200 million/year. The Government proposes to keep this content as in the draft Law submitted at the 7th Session, thereby assigning the authority to the Government to stipulate the threshold level of annual revenue not subject to tax to ensure timely management in accordance with reality and the changing socio-economic context.

Opinions discussed at the Session did not propose that the Government regulate the revenue level of goods and services not subject to value added tax; some opinions proposed to raise this revenue threshold to over 200 million, others suggested a level of around 300 million VND or 400 million VND for the coming years.

At the meeting of the Standing Committee of the Finance and Budget Committee and the drafting agency, the drafting agency agreed to increase the threshold by VND200 million/year and remove the regulation on adjustment according to CPI. The majority of opinions of the Standing Committee also agreed with this handling plan. However, the drafting agency emphasized that this content needs to be consulted with the Government leaders to reach consensus.

Concluding the discussion at the meeting, Vice Chairman of the National Assembly Nguyen Duc Hai said that to ensure the principle of the National Assembly deciding by majority, consensus, and high consistency with the provisions of the Law, the National Assembly Standing Committee will seek opinions from National Assembly deputies on transferring fertilizers, agricultural machinery, and fishing vessels from non-taxable to 5% taxable.

The Vice Chairman of the National Assembly once again emphasized the spirit of innovative thinking in law-making. The National Assembly only decides on what is within its authority, and the Government will implement and take responsibility for any content under the Government's authority.

Regarding the content that the Government has different opinions between the times of submitting, receiving and revising the draft law, the Government needs to have a specific report to ensure consistency and narrow down the contents that still have different opinions.

Regarding the contents discussed that still have different opinions among National Assembly deputies, Vice Chairman of the National Assembly Nguyen Duc Hai said that it is necessary to study and absorb as much as possible of the opinions, and at the same time explain clearly and objectively to create consensus.

According to the program, this bill will be considered and voted on by the National Assembly on November 26 at the 8th Session.
