Buying social housing must have 3 conditions
As someone who is in need of housing but missed out on a social housing (NOXH) spot in the recent sale in Hanoi, reader NTT asked the representative of the Ministry of Construction about the method of purchasing NOXH, how to ensure transparency, fairness, and publicity in the distribution of NOXH?
In response to this question, Mr. Ha Quang Hung said that currently the method of selecting social housing buyers is by drawing lots, while previously there was a scoring method. With this method, some policy beneficiaries will be given priority in supporting home purchases.
"Through monitoring, determining priorities does not solve the core problem. In the scoring process in some localities, there are still negative incidents. Based on the feedback from localities, we are currently choosing the lottery method to ensure fairness and transparency," said Mr. Hung.
Finding solutions to 'untie' social housing
However, according to Mr. Hung, to be eligible for the lottery, participants must be in the category prescribed by current law. Specifically, in addition to belonging to one of the 10 groups of subjects specified in Article 49 of the 2014 Housing Law, home buyers must meet 3 conditions.
Specifically: do not have a house or have a house but the average area in the household is less than 10 m2 /person; belong to the group of subjects not yet required to pay personal income tax, income is less than 11 million VND/month after family deductions; must be a person with permanent residence in the locality where the project is located or must have documents confirming social insurance payment proving that they are living and working in the area.
Local authorities are responsible for checking specific subjects and conditions.

To ensure transparency and fairness in purchasing social housing, Mr. Hung said, the Ministry of Construction is building an information portal on eligible subjects to buy houses. After identifying eligible subjects to buy social housing, localities will post this list.
"Later, when implementing e -Government and integrating CCCD, we can go to this portal to check, type in the name of the person who registered to buy, and relevant information about the subject and conditions will appear. Each subject can only benefit from the policy once, if someone has already purchased, they will not be able to buy again," Mr. Hung informed.
Incorrect buyers of social housing will have their houses confiscated and be administratively fined.
A reader in Ba Dinh District (Hanoi) sent a question to Mr. Bui Kien Thanh, Head of Urban Development Department (Hanoi Department of Construction), reflecting: "In reality, recently there has been a situation where "brokers" openly advertised social housing for sale, showing signs of taking advantage of policies. What is the inspection and handling process to ensure that social housing reaches the right subjects?"
Mr. Thanh said that the process of selecting social housing buyers belongs to the investor and has specific regulations; the city and government cannot change it.
Brokers advertising social housing for sale, trading floors, and price differentials are completely prohibited. The Hanoi People's Committee has requested investors to strictly implement, publicly and transparently to avoid profiteering.

In addition, the Hanoi Party Committee has issued separate instructions and assigned the People's Committees of districts to supervise; directed departments and branches to establish inspection teams; and when violations are discovered, they must be recovered immediately.
"There are also specific regulations regarding the revocation. If violations or wrong objects are discovered, the investor can cancel the contract. If the buyer of social housing is not the right object, he or she will be fined for administrative violations," Mr. Thanh emphasized.
To avoid these cases, Mr. Thanh said, the Hanoi Department of Construction advised the Hanoi People's Committee to issue Decision 25 in 2019 to establish a community monitoring team, with authorities and buyers monitoring the investor when purchasing and after purchasing, until use, and continuing to monitor until transferring to the building management board. When violations are detected at any stage, there are regulations for handling and recovering the house.
"The current process of monitoring the purchase and use of social housing for the right subjects is very strict," the Head of the Urban Development Department emphasized.
