Accordingly, after organizing and arranging the authorities at all levels, the Department of Education and Training is decentralized and delegated the authority to perform the following functions and tasks related to teacher management:

- Advise and submit to the Provincial People's Committee and competent authorities to decide on job positions, civil servant payroll, and total number of employees at public schools.
- The Department of Education and Training carries out recruitment, employment, appointment, change of job titles, training, fostering, and evaluation of teachers, education managers, and staff of public schools.
- The Department is also responsible for developing plans for recruitment, use, training and development of teachers in localities and schools in the province.
- Ensure sufficient number of civil servants and employees according to the project approved by the Provincial People's Committee. At the same time, be responsible for explaining the activities, quality of education, teachers, workers and students.
- The Department of Education and Training has the right to recognize, appoint, dismiss, transfer, and change job positions of principals and vice principals of schools.
- The Department is responsible for regularly updating information on teachers and managers in the national database on education and management levels such as the Provincial People's Committee and the Ministry of Education and Training.
Previously, public teacher recruitment was carried out like general civil servant recruitment, by the Department of Home Affairs and the People's Committees at district/provincial levels.
Thus, in the coming time, the function of recruiting teachers at all levels will be decentralized and delegated more strongly to the Department of Education and Training of localities (for preschool level, the commune will decide on recruitment). This can be considered one of the breakthrough decisions of the education sector, expected to solve the problem of local teacher shortage in localities and use the right talent for schools.
This new decision also coincides with the content of the draft Law on Teachers, which is being discussed by the National Assembly at the 8th Session (October 2024) and the upcoming 9th Session.
Accordingly, the authority to recruit teachers in public schools is chaired by the education management agency or delegated to educational institutions.
For schools with autonomy, the principal is responsible for recruitment. For non-public schools, recruitment is conducted by the school according to the school's regulations on organization and operation.
The draft also stipulates that the mobilization, arrangement and appointment of teachers will be presided over by educational management agencies, who will advise, decide or recognize according to their assigned authority.
Prof. Dr. Thai Van Thanh, Director of the Department of Education and Training of Nghe An province, said that assigning responsibility and initiative in recruiting and using teachers to the Department of Education and Training of localities can solve difficulties and limitations such as: The current assigned teaching staff at all levels is still lacking compared to the standards prescribed by the Ministry of Education and Training; The teacher structure is not reasonable, the situation of local surplus and shortage in some subjects at primary, secondary and high school levels due to the implementation of the new general education program...
In order for recruitment to be truly effective in the coming time, Prof. Dr. Thai Van Thanh proposed that the Ministry of Education and Training and the People's Committees of provinces and cities regulate the content, form and requirements on conditions and standards for recruitment specifically for teachers, to ensure that it is suitable for the characteristics of the profession, minimize administrative and public service requirements, and strengthen requirements and assessments of pedagogical capacity.
