VIOLATION OF THE LAW
During this period, the leaders of the My Dinh National Sports Complex (the complex) issued a policy allowing and creating conditions for the agency's trade union to use the premises at My Dinh Stadium to conduct business activities such as vehicle parking, tennis court rental, and placing sales booths when organizing events, with the revenue of more than 1 billion VND. However, this amount was not paid and recorded in the accounting books of the complex but was paid into the trade union fund for use in trade union activities.
The complex's leaders also allowed the Water Sports Palace Management Department (referred to as the management department - one of the two most important items of the complex) to use the premises to organize the service of keeping vehicles for visitors to swim and cars for visitors to park on the grounds of the palace (from 2011 to April 2018). The amount of money collected was 1.7 billion VND but was not submitted and recorded in the accounting books of the complex, but was paid into the management department's fund. From October 2013 to April 1, 2017, the leaders of the management department, who kept the money and related revenue and expenditure documents, counted the amount of money collected from the security team to keep vehicles less than the amount the security team submitted to the management department by 350 million VND. This department also organized its own canteen service business, selling and renting swimsuits (from May 2018 to December 31, 2018).
My Dinh Stadium is the largest sports institution in Vietnam but is facing serious financial problems.
The above policies of the complex's leaders led to this unit operating some services without conducting auctions. The signing of contracts to lease premises for the above services, the amount collected was nearly 2.9 billion VND but was not paid and recorded in the complex's accounting books. According to the competent authority, the complex in the period from 2009 to 2018 violated the provisions of Article 6 of the Law on Management and Use of State Assets, Article 10 of the Law on Management and Use of Public Assets, causing losses to the complex's revenue. The responsibility belongs to the leaders of the complex, the Department of Management of the Water Sports Palace, and the Department of Management of My Dinh Stadium during this period.
T THE REVENUE IS NOT ENTRANCED INTO THE BOOKS
From 2015 to 2017, the complex also had some financial activities that were not in accordance with the circular of the Ministry of Finance. Specifically, in March 2015, the Director of the complex signed a contract to lease premises with a business but without auction. After signing the contract, the director and the representative of this business signed 2 additional appendices to the contract to reduce the rental price. The unreasonable and arbitrary price reduction by the Director of the My Dinh complex reduced the unit's revenue.
Recently, Deputy Prime Minister Tran Hong Ha has directed many ministries and branches to resolve the problems and difficulties that the complex is facing.
After the contract period expired, the contract liquidation was not carried out, the Director of the complex did not reclaim the premises but continued to sign a contract to lease the premises to the above enterprise to operate the swimming season in 2017 and 2018 for an amount of 120 million VND/season. The enterprise completed the swimming season in 2017, the amount to be paid to the complex was 120 million VND. However, the Director of the complex, the Head of the Business Planning Department of the complex (the person who initialed the contract) did not enter the contract into the books for monitoring, the amount was not paid to the complex, leading to loss of revenue for the complex. The authorities clearly stated that the responsibility for the above violations lies with the Director of the complex and the Head of the Business Planning Department. However, up to this point, the individuals who violated the contract have not been properly handled. Currently, the complex's debt has reached more than 900 billion VND and this unit is unable to pay.
