New regulations on service price declaration, what are the benefits for seaport enterprises?

With the new regulation, businesses are allowed to self-determine service prices at seaports and send declaration documents to state management agencies.

The Ministry of Transport (MOT) has just issued Circular No. 31/2024 amending and supplementing a number of articles of Circular No. 12/2024 of the Minister of Transport regulating the mechanism and policies for managing service prices at Vietnamese seaports.

Many services such as maritime pilotage, container loading, unloading or container cleaning will have to declare prices.

The notable point in the Circular is the addition of many services at seaports that will be subject to price declaration, including: Maritime pilotage; use of bridges, wharves, and mooring buoys; loading and unloading containers; towing ships; loading and unloading other goods, including: dry cargo, bulk cargo, and liquid cargo; tying and untying ships; storage of goods at seaport warehouses, including services for storing containers, dry cargo, bulk cargo, and liquid cargo; counting, packing and unpacking goods at seaports; making and issuing shipping documents for containers transported through seaports; clamping and unsealing containers transported through seaports; cleaning containers, applicable in cases where goods contaminate containers, resulting in container cleaning services; environmental sanitation, including services for collecting, classifying, and treating waste from ship operations at ports".

According to the Vietnam Maritime Administration, the addition of content on price declaration is in accordance with the provisions of Decree 85/2024. The Decree stipulates that the Ministry of Transport shall issue legal documents to regulate economic and technical characteristics (detailed names, specific types or basic characteristics of goods and services).

According to the representative of the Vietnam Maritime Administration, the new regulation creates many favorable conditions for businesses. Accordingly, instead of having to submit a declaration to the State management agency for approval before applying the price as before, now, businesses can self-determine and apply the price and then submit the declaration to the State management agency for statistics.

"With the new regulation, businesses will have more freedom to set their own service prices. Of course, the price must be within the prescribed price range," said a representative of the Vietnam Maritime Administration.

In Decree 85/2024 detailing a number of articles of the Law on Prices, price declaration serves the needs of synthesizing, analyzing, forecasting market prices and the requirements of state management of prices. At the same time, it serves the work of price stabilization, state management of prices, price inspection and examination.
