According to the new Decision, the Steering Committee for reviewing and handling difficulties in the system of legal documents has changed its name to the Steering Committee for reviewing and organizing the handling of difficulties in the legal system.
Prime Minister Pham Minh Chinh signed Decision No. 1512/QD-TTg amending and supplementing Decision No. 603/QD-TTg dated July 8, 2024 of the Prime Minister on the establishment of the Steering Committee to review and handle difficulties in the system of legal documents.
According to Decision No. 1512/QD-TTg, the Steering Committee for reviewing and handling difficulties in the system of legal documents changed its name to the Steering Committee for reviewing and organizing the handling of difficulties in the legal system.
The Head of the Steering Committee is Prime Minister Pham Minh Chinh.
Deputy Prime Minister Le Thanh Long is the Deputy Head of the Steering Committee.
Deputy Heads of the Steering Committee include: Minister, Head of the Government Office; Minister of Planning and Investment; Minister of Justice.
Members of the Steering Committee include: Ministers of Public Security, Finance, Foreign Affairs, Industry and Trade, Agriculture and Rural Development, Construction, Natural Resources and Environment, Transport, and Home Affairs; Governor of the State Bank of Vietnam; Government Inspector General; Deputy Minister of Justice Tran Tien Dung.
In addition, the Steering Committee also invited leaders of the Law Committee, the Economic Committee, the Finance and Budget Committee of the National Assembly; and the Vietnam Federation of Commerce and Industry (VCCI) to participate in the Steering Committee.
According to Decision No. 603/QD-TTg dated July 8, 2024, the Steering Committee for reviewing and organizing the handling of problems in the legal system has the function of assisting the Prime Minister in researching, directing, and coordinating the review and handling of problems in the system of legal documents.
The Steering Committee's task is to direct ministries and agencies to promptly handle, within their authority, any difficulties and inadequacies in legal regulations as pointed out in the Government's Reports on reviewing the system of legal documents implementing Resolution No. 101/2023/QH15 and Resolution No. 110/2023/QH15 of the 15th National Assembly; at the same time, continue to synthesize and review arising difficulties and inadequacies (if any).
Direct ministries, agencies and localities to review legal documents, especially the State Budget Law, the Public Debt Management Law, the Public-Private Partnership Investment Law, the Public Investment Law, the Tax Law, the Pharmacy Law... and guiding documents, identify obstacles and bottlenecks that need to be focused on removing at the legal level.
Propose that the Government report to the National Assembly at the 8th Session of the 15th National Assembly to consider and issue appropriate and effective documents to immediately handle legal problems and difficulties arising in practice, hindering development.
The Ministry of Justice is the standing agency of the Steering Committee.
The Standing Agency of the Steering Committee reviews and organizes the handling of problems in the legal system and is responsible for ensuring the operating conditions of the Steering Committee, using existing agencies and functional units of the ministry to organize the implementation of the Steering Committee's tasks; coordinating, monitoring, supervising and evaluating the implementation results of ministries, branches and localities; synthesizing, preparing reports and submitting to the Head of the Steering Committee and the Prime Minister the implementation results periodically and suddenly.
At the first meeting of the Steering Committee, the Prime Minister clearly stated the goal of reviewing and handling obstacles in the system of legal documents to contribute to overcoming the situation of avoidance, shirking, fear of mistakes, fear of responsibility, not daring to think, not daring to do, and stagnation among a number of cadres and party members; improving the investment and business environment, promoting decentralization, reforming administrative procedures, building a socialist rule-of-law state; contributing to the goal of stabilizing the macro economy, controlling inflation, promoting growth, ensuring major balances of the economy and major goals according to the Resolution of the 13th National Party Congress.
The Prime Minister pointed out that after reviewing, it is proposed to build a law amending many laws according to shortened procedures to handle problems, and submit it to the National Assembly as soon as possible.
The Prime Minister requested that heads of ministries, branches, agencies and localities directly direct the work of building and perfecting laws and institutions within their management scope; at the same time, arrange legal officers with sufficient capacity, qualifications, enthusiasm and passion for the work and pay attention to regimes and policies suitable for the team of officers doing legal work./.
