On the afternoon of August 7, at the Government Headquarters, Prime Minister Pham Minh Chinh - Head of the Steering Committee for reviewing and handling difficulties in the system of legal documents chaired the second meeting of the Steering Committee. Also attending were Deputy Prime Minister Le Thanh Long; representatives of leaders of central ministries and branches.

Speaking at the meeting, Prime Minister Pham Minh Chinh stated that, after the decision to establish the Steering Committee to review and handle difficulties in the system of legal documents, on July 8, the Government Standing Committee and the Steering Committee held the first meeting to identify key tasks and solutions. In particular, clearly identifying the tasks that the Ministry of Justice (Standing Body of the Steering Committee) and ministries, branches and localities need to focus on implementing, which are: reviewing and amending contents related to decentralization and delegation of power (building mechanisms, policies, laws, planning, building inspection and supervision tools, not doing specific tasks); cutting down and simplifying administrative procedures; eliminating the request-grant mechanism; combating harassment and inconvenience for people and businesses; clearing and effectively using all resources for development, taking public investment and State resources as the guide and activating all other legal resources, including foreign investment capital.

Based on the review, develop a law to amend and supplement a number of laws with simplified procedures to handle problems according to the principle: ministries and branches take the lead in drafting laws to amend laws under their management, report to the Government for consideration, and submit to the National Assembly at the 8th Session.
In this Session, the Prime Minister requested the Ministry of Justice to report on the progress and results of the implementation of the conclusions of the Government Standing Committee at the First Session, including: assessing the situation of ministries and branches performing the task of handling the results of document review as indicated by the Government in the Reports on the review of legal documents serving Resolution 101/2023/QH15 and Resolution 110/2023/QH15 of the 15th National Assembly; reporting on the results of the review, summarizing urgent legal difficulties and problems at the law level that need to be focused on studying and resolving, and proposing plans to assign ministries and branches to study and handle.
Proposing effective and comprehensive solutions to carry out the tasks assigned by the Government in Resolution 82/NQ-CP, Resolution 93/NQ-CP and Decision 81/QD-BCDRSXLVBQPPL dated July 25, 2024 promulgating the Steering Committee's Action Plan.

Based on the Report of the Ministry of Justice, the Prime Minister requested delegates to focus on discussing and giving opinions on the following main issues: giving direct opinions on the contents of the structure, layout and main contents of the Report. Review and re-evaluate how the tasks in Decision 81 of the Steering Committee and the Conclusion of the Government Standing Committee (Notice 322/TB-VPCP dated July 15, 2024 of the Government Office) have been implemented? Are there any problems or difficulties? What are the causes and solutions? Review and evaluate the current situation of document processing after review in the past time, in which it is necessary to clearly identify the main subjective and objective causes of the delay in document processing after review? It is necessary to propose specific solutions to speed up the progress and quality of document processing after review? Have the problems and shortcomings that have been summarized by the Ministry of Justice closely followed the direction of the Steering Committee? What content needs to be handled immediately to promote growth, control inflation and stabilize the macro economy?

Regarding the legal problems of 13 laws as reported by the Ministry of Justice, the Prime Minister requested the Ministry of Planning and Investment, the Ministry of Justice, and the Ministry of Finance to provide comments on the progress and scope of amendments to resolve them immediately, and submit them to the National Assembly at the 8th Session (October 2024). Time is limited, requirements are numerous, and the content is rich and difficult, so the Prime Minister hopes that delegates will focus their intelligence, report, and contribute opinions concisely, frankly, and directly to the point.
* According to the Ministry of Justice, regarding the implementation of the review task and handling of review results: based on the request and guidance documents of the Ministry of Justice sent to relevant ministries, branches and People's Committees of provinces, up to now, the Ministry of Justice has received reports from ministries and localities, specifically:
15 ministries and ministerial-level agencies have reported on the review of legal documents according to Resolution No. 93/NQ-CP dated June 18, 2024 of the Government: State Bank; Ministry of Health; Ministry of Transport; Ministry of Culture, Sports and Tourism; Ministry of National Defense; Ministry of Construction; Ministry of Information and Communications; Ministry of Public Security; Ministry of Foreign Affairs; Ministry of Agriculture and Rural Development; Committee for Ethnic Minorities; Ministry of Home Affairs; Ministry of Finance; Ministry of Industry and Trade; Ministry of Planning and Investment.

55 localities and a number of associations and enterprises have reported on the review of legal documents according to Resolution No. 93/NQ-CP dated June 18, 2024 of the Government.
Closely following the Conclusion of the Government Standing Committee on the Steering Committee for reviewing and handling difficulties in the system of legal documents (Notice No. 322/TB-VPCP dated July 15, 2024 of the Government Office), specifically: "Focus on reviewing and handling urgent difficulties in a number of laws to remove difficulties, obstacles, and bottlenecks to promote growth, control inflation and stabilize the macro-economy" and the results compiled up to now (July 31, 2024), the total number of recommendations that have been compiled within the scope of the above conclusion is 594 recommendations.
In which: Investment Law: 47 recommendations; Public Investment Law: 241 recommendations; Public-Private Partnership Investment Law: 32 recommendations; Enterprise Law: 29 recommendations; Planning Law and Law amending and supplementing a number of articles of 37 laws related to planning: 22 recommendations; State Budget Law: 131 recommendations, Tax Administration Law: 14 recommendations; Law on Management and Use of Public Assets: 19 recommendations; Accounting Law: 31 recommendations; National Reserve Law: 2 recommendations; Independent Audit Law: 11 recommendations and Securities Law: 15 recommendations.
Based on the synthesis results, the Standing Body of the Steering Committee has developed 12 Appendices for the results of reviewing 13 Laws including: Investment Law, Public Investment Law, Law on Investment under the Public-Private Partnership (PPP Law), Enterprise Law, Planning Law and Law on amending and supplementing a number of articles of 37 laws related to planning; State Budget Law, Tax Administration Law, Law on Management and Use of Public Assets, Accounting Law, National Reserve Law, Independent Audit Law and Securities Law.
Regarding the review results in other legal fields, the Standing Body of the Steering Committee is coordinating with ministries and branches to research, review and will propose appropriate solutions in the next meetings of the Steering Committee.
Regarding the review and development of laws amending and supplementing a number of laws on promoting growth, controlling inflation and stabilizing the macro-economy: based on 594 recommendations from the review results of the 13 Laws mentioned above, the results of the review of the system of legal documents implementing Resolution No. 101/2023/QH15 and Resolution No. 110/2023/QH15 of the 15th National Assembly, combined with the synthesis of information from the appraisal of legal documents of the Ministry of Justice, research on proposals from ministries, agencies, localities and the Conclusion of the Government Standing Committee in Notice No. 322/TB-VPCP dated July 15, 2024, to meet new requirements arising in the practice of state management, especially issues arising after the Covid-19 pandemic, the Ministry of Justice and the Steering Committee's Working Group have compiled and classified the difficulties and inadequacies that need to be handled in this Report after receiving feedback. review, exchange and evaluate between state management agencies of the industry and field that the document regulates.
