On the morning of February 19, with 455/459 delegates participating in the vote in favor (accounting for 95.19% of the total number of delegates), the National Assembly passed the Resolution of the National Assembly on the investment policy of the Lao Cai - Hanoi - Hai Phong Railway Construction Investment Project.
According to the draft resolution, the construction of a new, modern and synchronous railway line aims to meet the domestic and international transport needs between Vietnam and China; create an important driving force for rapid and sustainable socio-economic development, promote advantages on the Lao Cai - Hanoi - Hai Phong economic corridor, ensure effective connection of domestic and international railway networks, associated with ensuring national defense, security and international integration, environmental protection, and response to climate change; promote the process of industrialization and modernization of the country; contribute to realizing the goals and tasks according to the Documents of the 13th National Congress of Delegates and Resolutions of the Party.
Regarding the scope, the starting point is at the cross-border rail connection point (Lao Cai province), the end point is at Lach Huyen station (Hai Phong city). The main line length is about 390.9 km; the branch lines length is about 27.9 km; passing through 9 provinces and centrally-run cities including: Lao Cai, Yen Bai, Phu Tho, Vinh Phuc, Hanoi, Bac Ninh, Hung Yen, Hai Duong and Hai Phong.
Regarding scale, new investment in the entire single-track line, 1,435 mm gauge; general passenger and cargo transportation; design speed of 160 km/h for the main line from the new Lao Cai station to Nam Hai Phong station, design speed of 120 km/h for the section through the Hanoi hub area, design speed of 80 km/h for the remaining sections.
The project applies rail technology and electrification; ensuring modernity, synchronization, safety and efficiency.
Regarding specific and special mechanisms and policies, in particular, during the project implementation process, the Prime Minister is allowed to decide to issue government bonds for the project to supplement the shortfall compared to the annual public investment plan and estimate approved by the National Assembly without increasing the state budget deficit.
Mobilizing official development assistance (ODA) capital and foreign concessional loans to implement projects without having to prepare project proposals using ODA capital and foreign concessional loans; applying regulations of foreign sponsors in cases where Vietnamese law does not have regulations or has regulations but they are different from those of foreign sponsors.
Use the annual central budget revenue and expenditure savings (if any) and other legal capital sources for the project in case the annual state budget estimate does not meet the progress. The use of the annual revenue and expenditure savings does not have to be implemented in the order of priority as prescribed by the law on the state budget.
The project does not have to conduct an appraisal of capital balance capacity according to the provisions of the Law on Public Investment.
Regarding the development, exploitation of land funds and added value from land in the vicinity of railway stations, the Provincial People's Committee shall organize the establishment and adjustment of zoning plans and detailed plans in the vicinity of railway stations to determine the location, boundaries and area of recovered land.
In the vicinity, the provincial People's Committee is allowed to decide on planning, architecture, technical infrastructure, social infrastructure, space and land use requirements other than those specified in national technical regulations, but must ensure compliance with technical infrastructure and social infrastructure systems; adjust the function of land use in the vicinity of railway stations to exploit land funds and added value from land.
For areas with approved urban and rural planning and land use planning, but when establishing or adjusting the planning of the railway station vicinity, there are new proposals that are different from the approved planning content, the decision approving the planning of the vicinity area has superseding value and it is not necessary to carry out procedures to adjust the previously approved planning.
The Provincial People's Council decides to use the local budget to implement independent public investment projects to carry out compensation, support and resettlement work according to the planning of the area surrounding the railway station to create land funds for urban development according to the provisions of law.
Regarding the amount of money collected from exploiting land funds in the vicinity of railway stations, after deducting related costs according to the provisions of law, the provincial local government is allowed to retain 50% and pay 50% to the central budget to balance the state budget for investment in the project...
