Developing urban railway network system in Hanoi and Ho Chi Minh City

On the morning of February 19, continuing the program of the 9th Extraordinary Session of the 15th National Assembly, with 459/459 delegates participating in the vote in favor (accounting for 96.03% of the total number of delegates), the National Assembly passed the Resolution of the National Assembly to pilot a number of specific and special mechanisms and policies to develop the urban railway network system in Hanoi and Ho Chi Minh City.

Previously, in a summary report on the reception, explanation and revision of the draft resolution, Secretary General of the National Assembly and Head of the National Assembly Office Le Quang Tung said that there were opinions suggesting careful consideration of not implementing the procedures for establishing, appraising and deciding on project investment policies and decentralizing and delegating authority to localities to decide on investment to ensure an independent monitoring mechanism, and reviewing the regulation that it is not necessary to adjust land use planning and plans.

The National Assembly Standing Committee believes that, according to the Government's calculations, if following the normal procedures, the approval of investment policies will take about 3-5 years, even more than 5 years for some projects, which will not ensure the progress required in Conclusion No. 49-KL/TW of the Politburo.

In addition, the necessity of urban railway lines has been identified in the process of making relevant plans. Therefore, although the investment policy decision procedure is not carried out, the projects are still established, appraised, and approved for investment according to regulations to ensure that the investment decisions of the projects are truly appropriate and effective. Therefore, in the process of making the feasibility study report, it is recommended that the Government direct relevant agencies to carefully calculate to decide on reasonable project investment.

Regarding the proposal to consider not conducting architectural design competitions for stations, bridges, and intersections, the National Assembly Standing Committee said that, in order to ensure the progress of the projects and the long-term vision of these projects, the draft resolution has stipulated in the direction of giving the two cities the right to "decide" whether or not to conduct architectural competitions for urban railway projects.

Accordingly, the City People's Committee will consider and decide to organize architectural competitions for projects that need to ensure the preservation and promotion of cultural values, urban landscapes, create attraction and increase attractiveness for passengers using urban railways. For urban railway projects that do not conduct architectural competition, cities will decide to choose based on a number of architectural options proposed by consultants.

Regarding industrial development, technology transfer, and human resource training, the National Assembly Standing Committee said that the Government is currently researching and proposing a comprehensive mechanism and policy for development, technology, innovation, and technology transfer to remove bottlenecks and barriers, free up resources, encourage and develop science, technology, innovation, national digital transformation, and human resource development; reform management methods, implement scientific and technological tasks suitable for each type of research; innovate and digital transformation, and simplify administrative procedures to the maximum; and grant autonomy in the use of funds for scientific research and technology development.

During this session, the Government will submit to the National Assembly a joint resolution to institutionalize the mechanisms and policies in Resolution 57-NQ/TW; at the same time, Clause 5, Article 11 of the draft resolution allows the application of more beneficial mechanisms for the project...

Resolution on piloting a number of specific and special mechanisms and policies to develop the urban railway network system in Hanoi and Ho Chi Minh City includes 11 articles.

Notably, regarding the regulations specifically applicable to Ho Chi Minh City, the draft resolution states that in the TOD area (urban development model oriented towards public transport development), the Ho Chi Minh City People's Committee is allowed to collect and use 100% of a number of revenues to develop the urban railway system, public transport system, technical infrastructure connecting with the public passenger transport system: revenue from increased construction floor area of ​​civil construction projects due to increased land use coefficient and other planning indicators of the TOD area; revenue from exploiting added value from land in the TOD area; infrastructure improvement fees.

Ho Chi Minh City People's Council shall specify in detail the method of determining the collection level, authority, order and procedures for collecting money for the revenues specified in Clause 1 of this Article to ensure that there is no duplication of collection with other taxes and fees.

Ho Chi Minh City People's Committee is allowed to borrow through the issuance of local government bonds, borrowing from domestic financial institutions, other domestic organizations and from foreign loans of the Government to the city and other legal forms of capital mobilization with the total outstanding loan amount not exceeding 120% of the city's budget revenue according to decentralization. In case it exceeds 120%, the National Assembly shall consider and adjust the outstanding loan amount to suit the actual needs of the city.

Every year, during the budget execution process, the Ho Chi Minh City People's Council proactively decides on specific domestic loan sources and foreign loan sources guaranteed by the Government within the total outstanding loan balance and budget deficit of the city as decided by the National Assembly and assigned by the Prime Minister.

Ho Chi Minh City People's Committee organizes the appraisal and approval of the environmental impact assessment report; grants environmental licenses before the urban railway project, urban railway project under the TOD model is put into trial operation (if the project is subject to environmental licensing procedures), environmental registration (if the project is not subject to environmental licensing)...
