The situation of officials being afraid of making mistakes, afraid of responsibility and shirking work was mentioned by many National Assembly delegates at the group discussion session on the socio-economic situation on the morning of May 23.

Through many discussions and meetings, Mr. Thanh said that businesses still reflect that the handling of administrative procedures is still slow, and that public servants are still afraid of making mistakes and fearing responsibility, leading to shirking responsibility.

"There are things that were decided before but now we dare not decide; there are many things that we just ask our superiors, even the National Assembly Standing Committee," Mr. Thanh stated the reality.
Also concerned about this issue, delegate Dong Ngoc Ba (Standing Member of the Law Committee) suggested that the Government have a deeper assessment and statistics on the situation of a number of civil servants who are not resolute, have a mentality of avoiding, fearing responsibility, pushing things away, and fearing mistakes.
Citing a Government report, Mr. Ba said that by the end of 2023, nearly 18,000 officials had been disciplined. The delegate suggested that the Government assess and separate groups of violations, especially those related to violations of the Law on Civil Servants and public ethics such as shirking responsibility, shirking duties, and voluntarily quitting work, etc.
In addition, we must consider which unit is responsible for this situation. In case a unit has a civil servant who violates the law, we must consider the responsibility of the head.

Looking at it more generally, delegate Lo Thi Luyen (Dien Bien) said that the review of legal documents and the situation of avoiding and shirking responsibility by a group of civil servants need to be closely related.
According to her, the current system of legal documents has many problems, contradictions, overlaps, and inconsistent application, so civil servants must maintain safety, no one dares to do things that are not clearly regulated by law, because doing so will incur legal risks and in fact a number of civil servants have suffered legal risks.
"If you close your eyes and do it, at most you will go to jail. Who will take such a risk?", Ms. Luyen asked.
The female delegate immediately cited the story in Dien Bien and said that the locality could not do it, and civil servants did not dare to do it because the Law on Water Resources and the Law on Environmental Protection conflicted.
Because of this conflict, the locality cannot build hydroelectric projects from 2MW to under 20MW because the regulations do not clearly assign which agency to conduct the environmental impact assessment.
"The team of civil servants and the Provincial People's Committee do not dare to do it. If they blindly do it when a problem occurs, the inspection and investigation agencies will come in. So who dares to do it? Currently, the guiding document of the 2023 Law on Water Resources has not yet amended or supplemented this content," Ms. Luyen shared.

Therefore, she believes that the assessment of officials avoiding responsibility needs to be fully recognized.
In particular, the female delegate suggested that it is necessary to complete the legal basis to be clear, to avoid legal consequences.
Referring to Decree 73 on encouraging and protecting dynamic, creative cadres who dare to think, dare to do, and dare to take responsibility for the common good, Deputy Chairman of the Law Committee Nguyen Truong Giang requested the Government to report more clearly on the implementation process.
"Through recent press reports, even provincial leaders have said that the situation of shirking, avoiding, refusing to do things, and fearing responsibility is getting worse, while Decree 73 is already in place. This needs to be reported to the National Assembly," said Mr. Giang.
