'People use all kinds of tricks and tricks to circumvent' bidding

Discussing the revised Bidding Law on the morning of May 24, delegate Pham Van Hoa (Dong Thap delegation) said that not all fields need bidding and not all biddings bring practical results to the State.

According to Mr. Hoa, in reality, in the past there were cases where there were very high value bid packages, but when bidding, the value was very low.

"The tricks of some investors in the past, when wanting familiar contractors to win the bid, have very specific methods. As far as I know, some units and localities, every time this contractor participates, they win but the bid value is very low," said the delegate and suggested reviewing the process, procedures, registration, and organization of bidding to be effective.

Regarding bidding, the Dong Thap delegation also pointed out the fact that current binding regulations on bidding make some investors not dare to appoint contractors, "it is better to organize bidding which is more convenient and easier".

The reason, according to him, was that when the bidding was appointed, "the documents were very good, but halfway through, the contractor became "malnourished", the project was not effective. The investor was blamed for being close to the abc company, so the appointment was made". He also suggested that for bidding packages under 5 billion VND or several hundred million VND, competitive bidding should be organized to save time, cost and not bring efficiency.

Receiving and explaining the opinions of the delegates, Minister of Planning and Investment Nguyen Chi Dung said that the drafting agency determined that this is one of the difficult laws, not only in terms of policy but also legal techniques.

According to Mr. Dung, it is necessary to resolve the problems that arise and remove them during the implementation process, but also create favorable conditions for bidding activities and improve the effectiveness of state management in this field. Where is the balance between these two issues is a very difficult problem.

"If we manage too tightly, we will lose autonomy and cause difficulties, congestion, and have to make corrections as we have done many times. But if we manage too loosely, we will not be able to ensure state management, and it will become a vicious cycle," said Mr. Dung.

Sharing the view of delegate Hoa, according to the leader of the Ministry of Planning and Investment, bidding is multifaceted, there is no way to control all types. "Meanwhile, people use all kinds of tricks and tricks to get around it, we just cover it up, we cannot think of everything at once," said Mr. Dung.

He also gave examples of many businesses today, including foreign businesses, offering the lowest price but making profits by adjusting the total investment later, by selling accompanying raw materials, fuels, etc. "So now, do we get a low price or get all the common issues? This is a very difficult problem," Mr. Dung stated.

Regarding the removal of obstacles in bidding in the health sector, recent practice requires a fundamental and radical solution to completely remove difficulties and obstacles. The explanatory report of the National Assembly Standing Committee also stated very specifically the contents that have been accepted, revised and completed.

According to Mr. Dung, in addition to the problems in the law, there are also inadequacies, overlaps, and contradictions in the regulations of the decree and circulars that are not strict and consistent, causing difficulties.

Therefore, the draft law has dedicated a separate chapter with many provisions towards enhancing autonomy and self-responsibility for hospitals, facilitating the purchase of drugs and special medical equipment.
