Overseas Vietnamese are identified as one of the subjects that can be granted certificates of land use rights and assets attached to land (Clause 6, Article 4 of the 2024 Land Law).
At the same time, Clause 1, Article 44 of the 2024 Land Law stipulates: "Overseas Vietnamese who are allowed to enter Vietnam are allowed to own houses attached to land use rights in Vietnam, and have the right to use land due to receiving land use rights transfer in housing development projects".
According to Clause 1 and Clause 2, Article 8 of the Housing Law 2023, you are identified as one of the subjects eligible to own housing in Vietnam, provided that you are allowed to enter Vietnam.
Documents proving the subjects and conditions for owning houses in Vietnam are stipulated in Clause 2 and Clause 3 of Decree 95/2024/ND-CP as follows:
Firstly , documents proving the subject is eligible to own a house in Vietnam: Must have a foreign passport or valid international travel documents according to the law on entry and exit and documents confirming Vietnamese origin according to the law on nationality.
Second , documents proving the conditions for owning a house: Vietnamese people residing abroad must have a valid passport with an entry stamp to Vietnam or a valid international travel document with an entry stamp to Vietnam at the time of signing the housing transaction.
In your case, being a Vietnamese citizen means you are eligible to own a house in Vietnam. If your US passport is still valid and has an entry stamp into Vietnam at the time of signing the housing transaction, you are entitled to the rights to the house and land according to the law.
