According to Clause 1, Article 44 of the Land Law, overseas Vietnamese who are allowed to enter Vietnam are allowed to own houses attached to land use rights in Vietnam; have land use rights due to receiving land use rights transfer in housing development projects.
Article 3 of Decree 95/2024 stipulates documents proving subjects and conditions for owning houses in Vietnam.
Accordingly, documents proving conditions for home ownership are stipulated as follows:
- For Vietnamese people residing abroad who are Vietnamese citizens, they must have a valid Vietnamese passport with an entry stamp into Vietnam at the time of establishing a house as prescribed in Clause 2, Article 8 of the Housing Law .
- For Vietnamese people residing abroad, they must have a valid passport with an entry stamp to Vietnam or a valid international travel document with an entry stamp to Vietnam at the time of signing the housing transaction.
- For foreign individuals, they must have a valid passport with an entry stamp into Vietnam or equivalent legal documents for entry into Vietnam at the time of signing the housing transaction as prescribed in Point b, Point c, Clause 2, Article 17 of the Housing Law.
Thus, people who want to own a house in Vietnam need the following documents:
- For individuals who are Vietnamese citizens, they must have an identity card or passport or other valuable documents proving Vietnamese nationality.
- For people of Vietnamese origin residing abroad, they must have a foreign passport or valid international travel documents according to the law on entry and exit and documents confirming their Vietnamese origin according to the law on nationality.
- Foreign individuals must have a foreign passport and a written commitment that they are not entitled to diplomatic or consular privileges and immunities.
