According to Clause 1, Article 44 of the Land Law, people of Vietnamese origin residing abroad who are permitted to enter Vietnam are entitled to own houses attached to land use rights in Vietnam; and have the right to use residential land acquired through the transfer of land use rights in housing development projects.
Article 3 of Decree 95/2024 stipulates the documents proving eligibility and conditions for owning housing in Vietnam.
Accordingly, the documents proving eligibility to own a home are stipulated as follows:
- For Vietnamese citizens residing abroad, they must possess a valid Vietnamese passport with an entry stamp into Vietnam at the time of establishing the housing as stipulated in Clause 2, Article 8 of the Housing Law .
- For Vietnamese citizens residing abroad, a valid passport with an entry stamp into Vietnam or other valid international travel document with an entry stamp into Vietnam at the time of signing the housing transaction is required.
- For foreign individuals, a valid passport with an entry stamp into Vietnam or equivalent legal document for entry into Vietnam at the time of signing the housing transaction as stipulated in points b and c, clause 2, Article 17 of the Housing Law is required.
Therefore, those wishing to own property in Vietnam need the following documents:
- Individuals who are Vietnamese citizens must have an identity card, passport, or other valid documents proving their Vietnamese nationality.
- For people of Vietnamese origin residing abroad, they must possess a foreign passport or other valid international travel document in accordance with immigration laws, and a document confirming their Vietnamese origin as stipulated by nationality laws.
- Foreign individuals must possess a foreign passport and provide a written declaration stating that they are not entitled to diplomatic or consular privileges or immunities.
