On June 21, the National Assembly discussed the draft Law on Juvenile Justice.

Today, the National Assembly will discuss in the hall the draft Law on Juvenile Justice and the draft Law on amending and supplementing a number of articles of four laws.

On June 21, the National Assembly continued its legislative work.

In the morning, the National Assembly voted to pass the Resolution on the establishment of the National Assembly's Thematic Supervision Delegation and voted to pass the Law on Archives (amended).

Afterwards, delegates discussed in the hall the draft Law on Juvenile Justice. Chief Justice of the Supreme People's Court Nguyen Hoa Binh explained and clarified a number of issues raised by National Assembly delegates.

In the afternoon, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Land Law No. 31/2024/QH15, the Housing Law No. 27/2023/QH15, the Real Estate Business Law No. 29/2023/QH15, and the Law on Credit Institutions No. 32/2024/QH15.

Minister of Natural Resources and Environment Dang Quoc Khanh explained and clarified a number of issues raised by National Assembly deputies.

Reduced prison terms for minors

Previously, on the afternoon of June 6, Chief Justice of the Supreme People's Court Nguyen Hoa Binh presented to the National Assembly the Draft Law on Juvenile Justice.

The purpose of developing the Juvenile Justice Law project is to perfect the judicial law to be strict enough but also ensure humanity for juvenile offenders; Strengthen education, support, and help juvenile offenders to correct their mistakes and improve their behavior through diversion, minimizing the application of punitive and detention measures while still ensuring community safety and social order; Build a friendly procedural process, suitable for the age, psychology, maturity level, cognitive ability and for the best interests of juveniles;

Ensuring the basic rights of minors in handling, diversion, investigation, prosecution, trial, execution of judgment and community reintegration; Attracting and mobilizing human resources with expertise in social work; enhancing the responsibility of families, relevant agencies and organizations to support, supervise and educate minors; Establishing detention facilities suitable for the purpose of rehabilitation, education and development of minors; Increasing opportunities for community reintegration; building effective, professional and appropriate supervision, education and rehabilitation mechanisms for minors.

Notably, regarding penalties (Chapter VII - Part Three), the Draft Law stipulates:

- Maintain the current penal system. Do not apply life imprisonment and death penalty to minors.

- Reduce prison sentences for minors on a case-by-case basis.

- Add a provision on warning penalties. Reduce the probation period when serving a suspended sentence to no more than 3 years.

- Expand the scope of minors who can be fined and the fine amount shall not exceed one-third of the fine amount prescribed by law.

Presenting the report on the review of the draft Law, Ms. Le Thi Nga, Chairwoman of the National Assembly's Judicial Committee, expressed her approval of the necessity of promulgating the Law on Juvenile Justice.

Regarding specific penalties, maximum penalties and the summary of penalties for minors, the Judicial Committee basically agrees with the draft Law.

In addition, there is a proposal to extend the warning penalty to be applied to people from 14 to 16 years old who commit crimes for the first time, who are accomplices in a crime but have an insignificant role. There is a proposal to consider regulating the minimum level of fines and non-custodial reform.
