The People's Committee of Binh Dinh province has just issued regulations on locations and positions that are not in urban areas that must develop housing according to projects; areas where investors of housing construction projects do not use State capital must build houses for sale, lease-purchase, lease or transfer land use rights in the form of dividing plots into plots for sale for individuals to build their own houses in the province.
Accordingly, the People's Committee of Binh Dinh province stipulates that investors in housing construction investment projects must build houses (for sale, lease-purchase, or rent) in areas with high requirements for landscape architecture management, the frontage of regional-level roads and above and main landscape roads in urban areas; the area surrounding the works is an architectural highlight in the urban area as specified in planning projects, urban development programs, and architectural management regulations approved by competent authorities.
For the above areas, housing investors must ensure the following ratios: areas of communes in urban areas of type I and type II at least 50%; areas of communes in urban areas of type III, wards in urban areas of type IV, towns in urban areas of type IV at least 30%; areas of towns in districts (except An Lao, Van Canh, Vinh Thanh districts) and communes, areas with urban development orientation in urban areas of type IV at least 20%.
This ratio is determined by the ratio of the total land area required for housing construction to the total residential land area (excluding the current residential land area and land for social housing construction) of the project and is specified in the investment policy and detailed planning project.
In areas not covered by the above regulations, the investor of the housing construction investment project is allowed to transfer the land use rights in the form of dividing the land into plots for sale so that individuals can build their own houses according to approved sample designs, in compliance with approved detailed planning and urban design...
This Decision does not apply to housing construction investment projects in wards of urban areas of type I, type II and type III; projects subject to land use rights auction for housing construction investment projects according to the provisions of the Land Law. The above Decision takes effect from November 2, 2024 (replacing Decision No. 74, dated November 24, 2023).
Binh Dinh Provincial People's Committee guides that in case the investor of a housing construction investment project has submitted a dossier requesting permission to transfer land use rights in the form of dividing land into plots and selling them to individuals for self-construction of houses before November 2, 2024 but has not yet received a written permission from a competent state agency, the investor is responsible for supplementing the missing dossier according to the provisions of the Law on Real Estate Business No. 29/2023/QH15 and Decree No. 96/2024/ND-CP, dated July 24, 2024 of the Government for consideration by a competent state agency.
For housing construction investment projects that have been approved by competent authorities for investment policy, investment approval, and investor selection results before the effective date of Housing Law No. 27/2023/QH15, if the investor requests to transfer land use rights in the form of dividing land into plots for sale for individuals to build their own houses, they must be reviewed and implemented according to the above regulations; in case the project has approved land prices, it is necessary to re-determine land prices and fulfill financial obligations regarding land according to regulations.
