The Government has just issued Resolution No. 106 on the proposal to develop a Law amending and supplementing a number of articles of the Law on Officers of the Vietnam People's Army (VPA).
The Government highly appreciates the Ministry of National Defense for presiding over and coordinating with relevant ministries and agencies to propose the drafting of laws in accordance with the provisions of the Law on Promulgation of Legal Documents.
The Government agreed on the purpose of building the law to continue institutionalizing the Party's guidelines and policies and the State's policies on building the Vietnam People's Army, including building the officer corps.

The Government basically agreed on the three policies of the proposed Law. The Ministry of National Defense studied and accepted the Government's opinions and those of the Government members, and completed them to ensure the requirements.
It is necessary to carefully assess the impact and clearly explain the necessity of adding the position of deputy officer to the basic position system of military officers; and prescribe equivalent positions and titles for deputies and officers not holding command positions.
Regarding the policy of increasing the service age of officers of the Vietnam People's Army, it is necessary to consider special cases of talented people whose service age is extended to avoid wasting trained and experienced human resources. At the same time, it is necessary to continue studying policies to attract and "retain" talented people suitable to the characteristics of the Vietnam People's Army, meeting the needs of national defense and security development.
Regarding some contents related to the regime and policies for officers (such as conferring military ranks to graduates of reserve officer training, policies on housing, salary, and termination of active service), the Government noted to continue researching and assessing policy impacts in accordance with the provisions of the Law on Promulgation of Legal Documents, ensuring consistency with relevant laws (such as housing, land, etc.).
The Government assigned the Ministry of National Defense to preside over and coordinate with the Ministry of Justice, the Government Office and relevant ministries and agencies to study, receive Government opinions, and complete the dossier proposing the law making.
The Government assigned the Minister of Justice, authorized by the Prime Minister, to sign on behalf of the Government a submission to the National Assembly Standing Committee to add this law to the National Assembly's 2024 Law and Ordinance Development Program (draft a law according to a shortened order and procedure, submit it to the National Assembly for consideration and approval at the 8th session of the 15th National Assembly - October 2024).
The Law on Officers of the Vietnam People's Army in 1999 was passed by the 10th National Assembly at the 6th session on January 21, 1999, and took effect from April 1, 2000. After two summaries, the Ministry of National Defense reported to the Government and submitted to the National Assembly for amendments and supplements twice in 2008 and 2014. According to the Ministry of National Defense, it is expected to propose amending and supplementing 10 articles of the law, including: Basic positions and equivalent positions and titles of officers; age of service of officers; highest military rank for officer positions; shortening the time limit for consideration of promotion to the rank of lieutenant; and adding regulations on early salary increase. In addition, there are salaries, allowances, housing, land and working conditions for active officers; service age of reserve officers; appointment to positions, conferment and promotion of reserve officers' ranks; responsibilities of ministries, branches and local authorities in organizing the implementation of the law. |
