One of those contents is: "Implementation of non-budgetary revenues and expenditures; non-refundable voluntary support contributions in cash, in kind or non-material from non-state budget sources of domestic and foreign agencies, organizations and individuals". The Inspectorate of the Department of Education and Training is responsible for proactively advising, organizing inspections, checks and handling violations (if any) according to regulations.
At the beginning of this school year, the Ministry of Education and Training also issued a document requesting: "Strengthen inspection, examination, supervision and be accountable to learners and society about the collection levels and fees of educational institutions; absolutely do not allow the situation of "overcharging" at the beginning of the school year...".
Circular 55 stipulates the regulations of the parent-teacher association issued by the Ministry of Education and Training, clearly stating the amounts that students cannot donate.
Educational institutions wishing to organize social mobilization and fundraising must comply with the provisions of Circular 16 issued in 2018 by the Ministry of Education and Training on funding for educational institutions in the national education system.

There is no shortage of documents and plans for inspection, examination and supervision, but every year illegal collection occurs, making public opinion more indignant than the previous year. Does the Ministry of Education and Training see the need to review the feasibility and effectiveness of these directives?

From a legal perspective, answering Thanh Nien reporter, lawyer Le Trung Phat, Director of Le Trung Phat Law Firm (HCMC), said that the key cause, which is also the solution to the problem of over-collection and improper revenue and expenditure at the beginning of the year, according to him, is the thorough implementation of each school, here is the role of the principal, of the school's party cell secretary. In a recent interview with Thanh Nien , teacher Nguyen Van Ngai, former Deputy Director of the Department of Education and Training of Ho Chi Minh City, affirmed that in this story, the biggest role and responsibility belongs to the head of the unit - the school principal.
According to Mr. Ngai, as the head of the school, the principal must be exemplary, set an example, and be responsible for understanding documents, regulations, and instructions from superiors to implement in his school. During the implementation process, if the principal finds anything inappropriate or needs to be adjusted, he should report it to the superior agency; but while waiting for instructions, the principal must still comply with the provisions of the law and current documents.
Mr. Ngai also proposed that regular and surprise inspections by the Departments of Education and Training and the Departments of Education and Training during the school year must be effective; any cases of intentional violations that lead to overcharging must be strictly handled and publicly handled throughout the industry as a deterrent.
