To establish a branch in Vietnam, foreign universities must be in the world's top 500.

The Government has just issued Decree No. 124 amending and supplementing a number of articles of Decree No. 86/2018 of the Government regulating foreign cooperation and investment in the field of education. Notably, this decree has added many provisions on allowing foreign universities to establish branches in Vietnam.

Specifically, foreign universities investing in establishing branches in Vietnam must be established and operate legally abroad, and be among the top 500 universities ranked in the world's prestigious university rankings for one of the last three years.

To be granted a certificate, a branch of a foreign university in Vietnam must comply with the planning of the network of university and pedagogical institutions according to the provisions of the 2012 Law on Higher Education, the Law amending and supplementing a number of articles of the 2018 Law on Higher Education and the Law on Planning.

The project to establish a branch of a foreign university in Vietnam must have a minimum investment capital of VND 500 billion (excluding land use costs). By the time of appraisal for permission to establish a university branch, the investment value must be over VND 250 billion.

In addition, the construction land area must not be lower than the prescribed land area for construction of branches of university education institutions invested by domestic investors and must ensure operating conditions.

The training program must be recognized or accredited by the competent educational agency or organization of the host country to meet the quality standards according to the standards of the host country, taught directly for at least 5 years in the host country as of the date of submission of the application for registration of operation; and approved for use in Vietnam by the foreign educational institution or organization that owns the educational program.

In addition, there must be no content that harms national defense, national security, or public interests; no religious propaganda or historical distortion; no negative impact on Vietnamese culture, ethics, or customs. At the same time, it must ensure connectivity between levels of education and training and connectivity when students transfer to study at public educational institutions according to regulations of the Ministry of Education and Training.

Regarding the staff, lecturers must have qualifications according to the regulations of the foreign university that invests in establishing the branch, but must not be lower than the lecturer standards prescribed by Vietnam; the student/lecturer ratio and the number of lecturers must be according to the regulations of the foreign university that invests in establishing the branch.

Branches of foreign universities in Vietnam are only granted degrees and certificates by the foreign universities that invested in establishing the branch.

The Prime Minister decides to allow the establishment of branches of foreign universities in Vietnam, and the Minister of Education and Training permits educational activities for these units.
