How will the revised Telecommunications Law impact the market?

Telecommunications service users will be provided with services of guaranteed quality.

On the morning of November 24, the National Assembly officially passed the Law on Telecommunications (amended) . The Law consists of 10 chapters and 73 articles.

A representative of the Telecommunications Department (Ministry of Information and Communications) said that the revised Telecommunications Law will promote the development of new telecommunications services. Specifically, the revised Telecommunications Law has added regulations on new telecommunications services, including basic telecommunications services on the Internet, cloud computing services, and data center services.

The regulation has legalized the business activities of basic telecommunications services on the Internet, cloud computing services, and data center services in a specialized legal document of the highest level, creating a clear legal environment for businesses to confidently provide services. With the “light management” approach, the revised Telecommunications Law will facilitate businesses, as it does not cause burdens for businesses, contributing to diversifying telecommunications products and services to serve the needs of people and businesses.

According to the Telecommunications Department, the Law stipulates that telecommunications infrastructure is facilitated for construction and installation on public land, public headquarters, and public works; completes regulations to enhance sharing and common use of passive telecommunications infrastructure among telecommunications enterprises and sharing telecommunications infrastructure with inter-sectoral technical infrastructure.

In addition, the Law supplements the responsibilities of People's Committees at all levels and relevant ministries and branches in handling acts that obstruct the legal construction of telecommunications works and supplements the responsibilities of enterprises with network infrastructure to withdraw and dismantle telecommunications works under their ownership and management that show signs of danger and do not ensure safety for exploitation and use.

The Law also adds the obligation of investors in the construction of apartment buildings, public works, functional areas, and industrial clusters to have a plan to design and build passive telecommunications infrastructure in construction investment and facilitate the establishment of telecommunications infrastructure; provide and use telecommunications services, and must design, build, and manage the use of telecommunications infrastructure to meet the needs of at least two telecommunications enterprises.

Continuing to share about the new points in the Telecommunications Law , the Telecommunications Department said that the Law will promote competition in telecommunications activities through regulations on wholesale activities in telecommunications, the obligation to provide wholesale services of telecommunications enterprises, and groups of telecommunications enterprises with a dominant market position must wholesale to other enterprises when requested, in order to promote the wholesale market, facilitate new enterprises to enter the market, develop new services and applications.

“The Law supplements the prohibition of using devices and software to send, transmit, and receive information via telecommunications networks to commit illegal acts; supplements regulations on the rights and responsibilities of telecommunications enterprises and subscriber owners in managing subscriber information, responsibilities to limit SIMs with incorrect subscriber information, limit spam calls, spam messages, and calls with signs of fraud; supplements the obligations of telecommunications subscribers, not to use information on their identity documents to enter into contracts to provide and use telecommunications services for others, except in cases permitted by the provisions of the law on telecommunications; and must be legally responsible for the use of telecommunications subscriber numbers for which they have entered into contracts with telecommunications enterprises," said a representative of the Department of Telecommunications.

To protect the rights of telecommunications service users, the revised Telecommunications Law also clarifies the responsibilities of telecommunications enterprises in ensuring the confidentiality of telecommunications users' information; protecting users' personal data; and ensuring service quality.

The Telecommunications Department said: “The entities that will be affected by the revised Telecommunications Law are telecommunications service providers. New telecommunications service providers (basic telecommunications services on the Internet, cloud computing services, data center services) will also be subject to the Telecommunications Law, however, they will be approached in a “light management” manner, with fewer obligations than traditional telecommunications businesses, while being legally operating under telecommunications law. These businesses will need to carefully study the new provisions of the revised Telecommunications Law to be able to properly and fully implement the regulations.”

In addition, telecommunications service users will also benefit from the revised Telecommunications Law. Specifically, telecommunications service users will have their rights better protected, including ensuring information confidentiality, protecting personal data from telecommunications businesses, and being provided with telecommunications services of guaranteed quality.
