The Ministry of Labor, Invalids and Social Affairs is seeking public opinions on the draft Decree on voluntary occupational accident social insurance (OSI) for employees working without contracts.
Self-employed workers aged 15 and over can participate in occupational accident insurance.
Accordingly, workers are eligible to participate in this type of insurance when they are 15 years of age or older and work in the informal sector. This type of insurance is part of the social insurance fund.
Workers receive one-time benefits
Employees participating in voluntary occupational accident insurance who have an accident during work and suffer a health loss of 5% or more will enjoy the following benefits: health assessment costs; one-time and monthly allowances; support for living aids and orthopedic devices.
When health is reduced by 5 - 30% due to work-related accidents, voluntary work-related accident insurance participants will receive a one-time benefit.
Specifically, a 5% loss of working capacity will receive a one-time allowance equal to 5 times the basic salary, then a further 1% loss will receive an additional 0.5 times the basic salary. If participating for many years, from the second year onwards, an additional 0.3 times the basic salary will be calculated.
From July 1, the basic salary will increase to 1.8 million VND/month. In case of participating in voluntary occupational accident insurance for 2 years, if you have an accident and lose 10% of your ability, you will receive a one-time subsidy of 14.04 million VND.
In case an employee has an accident leading to death (including death during treatment or recurrence of injury), relatives will receive a one-time allowance equal to 36 times the basic salary, or 64.8 million VND.
Or receive monthly allowance
In case a participant in the above insurance type has a work accident with a disability rate of 31% or more, he/she will receive a monthly allowance.
Specifically, when health declines by 31%, a monthly allowance of 30% of the basic salary will be provided, then for every additional 1% decline, 2% of the basic salary will be added; in case of paying insurance for less than 1 year, an additional 0.5% of the basic salary will be added, from the 2nd year onwards, an additional 0.3% of the basic salary will be added, and free health insurance will be provided.
If a worker has an accident and loses 40% of his/her ability, and has participated in voluntary occupational accident insurance for 2 years, he/she will receive a subsidy of VND 878,400/month.
In case an employee has an accident at work that results in a loss of 81% or more of his/her physical ability, accompanied by disabilities such as spinal paralysis, blindness in both eyes, amputation or paralysis of both limbs, or mental illness, in addition to the monthly allowance mentioned above, he/she will also receive a monthly service allowance equal to the basic salary (an additional 1.8 million VND/month).
In addition, in case the insured person has an accident and has to use life support devices or orthopedic devices, the cost will be paid according to the doctor's instructions.
Poor households are supported with 30% of the contribution level.
The voluntary occupational accident insurance premium is equal to 2% of the minimum wage in region 4. Currently, the minimum wage in region 4 is 3.25 million VND, meaning employees pay 65,000 VND/month.
In the case of informal workers from poor households who voluntarily pay occupational accident insurance, they will be supported with an additional contribution equal to 30% of the rural poverty line.
If the participant belongs to a near-poor household, 25% of the rural poverty line will be supported.
For participants not belonging to the above two groups, the State supports 10% of the poverty line. This support is paid by the local budget.
Workers can register for voluntary occupational accident insurance at the nearest social insurance agency.
Employees can choose to pay monthly, 3 months/time, 6 months/time, or 12 months/time.
