On the morning of June 27, with 388/450 National Assembly delegates present in favor (accounting for 79.84% of the total number of delegates), the National Assembly passed the Law on Road Traffic Order and Safety.
The Law on Road Traffic Order and Safety takes effect from January 1, 2025, except for the provision in Clause 2, Article 88, which will take effect from January 1, 2026. Before voting to pass the entire draft law, National Assembly deputies voted on Clause 2, Article 9 on prohibited acts, including the act of driving a vehicle on the road with alcohol concentration in the blood or breath, with 357/448 deputies voting in favor (accounting for 73.46% of the total number of National Assembly deputies). Previously, in the report explaining, accepting and revising the draft Law on Road Traffic Order and Safety, Chairman of the National Assembly's Defense and Security Committee Le Tan Toi said that the National Assembly Standing Committee had a full report explaining, accepting and revising the draft Law. Compared with the draft Law submitted to the National Assembly at the 7th Session, the draft Law has been accepted and revised with 9 chapters and 89 articles, keeping the same number of chapters and articles; Article 2 on the subjects of application has been omitted and Article 38 has been split into 2 articles; the content and technique of 87 articles have been accepted and revised, keeping the content of 1 article intact. Regarding general provisions, according to Mr. Le Tan Toi, National Assembly deputies have commented on the scope of regulation, interpretation of terms, principles of ensuring order and safety of road traffic, State policies, propaganda, dissemination, legal education, database on order and safety of road traffic and prohibited acts... All comments have been explained and accepted in the draft Report in full. Regarding the State's policy on road traffic order and safety, the National Assembly Standing Committee has directed discussions with the Government to agree on amending this provision in Clause 1, Article 4 of the draft Law to ensure feasibility and facilitate implementation. According to Mr. Le Tan Toi, regarding the regulation on the prohibition of: "Driving a vehicle on the road with alcohol concentration in the blood or breath", taking into account the opinions of the National Assembly deputies, the National Assembly Standing Committee has directed to add to Clause 5, Article 87, assigning the Ministry of Health to regulate the determination of alcohol concentration and endogenous alcohol concentration in the blood to serve as a basis for determining cases where a person driving a vehicle on the road has alcohol concentration in the blood or breath due to the use of wine, beer or other alcoholic beverages... Regarding road traffic rules, Chairman of the National Defense and Security Committee Le Tan Toi said that the opinions of the National Assembly deputies on general rules and specific rules have been expressed in the draft of the Full Report. Regarding the content on patrolling and controlling; commanding, controlling traffic and handling road traffic accidents, the National Assembly deputies have given specific opinions on the regulation on moving vehicles that violate stopping and parking; Traffic Command Center; ensuring order and safety of road traffic in cases of using roads and sidewalks for other purposes; responsibilities of vehicle drivers, related persons and persons present at the scene of road traffic accidents; statistics of road traffic accidents and the Road Traffic Accident Damage Reduction Fund... "The above opinions have been explained and fully accepted in the draft Full Report", Chairman of the National Assembly's Committee on National Defense and Security Le Tan Toi stated. Regarding state management of road traffic order and safety and the Implementation Provisions, accepting the opinions of National Assembly deputies, the National Assembly Standing Committee directed the addition of Clause 4, Article 88, stipulating: "Resolution No. 73/2022/QH15 of the National Assembly on pilot auction of automobile license plates ceases to be effective from the effective date of this Law" and added transitional provisions on this content in Clause 7, Article 89 of the draft Law. In addition to the above contents, Chairman of the National Assembly's Defense and Security Committee Le Tan Toi said that the National Assembly Standing Committee has directed research, review, and technical editing of the draft Law to make it suitable.
