Proposal not to include land valuation methods in the Land Law

Land valuation methods will not be included in the draft Land Law (amended), but will be based on specific cases and appropriate calculation methods will be applied, ensuring market value.

This proposal was made and received the approval of the majority of delegates attending the meeting on the afternoon of July 24 chaired by Deputy Prime Minister Tran Hong Ha to complete the draft Land Law (amended).

According to current regulations, land prices are determined by one of five methods, such as direct comparison, deduction, income, surplus and land price adjustment coefficient. Previous drafts of the Land Law (amended) also mentioned these methods of determining land prices.

However, at the meeting, delegates agreed with the proposal not to include land valuation methods in the draft Land Law (amended) this time. Instead, based on specific cases, appropriate methods will be applied, ensuring that land values ​​are determined close to reality.

Deputy Minister of Planning and Investment Nguyen Thi Bich Ngoc said that it is necessary to build a complete land data system to ensure accurate land valuation. In particular, Ms. Ngoc noted to refer to the experience of countries with land regimes similar to Vietnam.

"There should be clear regulations on the allocation of land use rights for projects through auction, bidding or agreement so that localities can implement smoothly," said the Deputy Minister of Planning and Investment.

Expressing his views, Deputy Prime Minister Tran Hong Ha said that the process of drafting the revised Land Law had issues that had not been included in the law, but if practical issues arise and it is deemed necessary, "we should boldly study and report to the Central Committee and the Politburo". The ultimate goal, Mr. Ha said, is to have a law that is practical, vital and visionary.

"The application of valuation methods depends on each case and situation. However, if the input data is accurate, any method applied will give the same result," said the Deputy Prime Minister.

Therefore, the draft Law needs to stipulate in principle, land valuation to be consistent with market value and most objective.

He noted that it is necessary to identify some important and stable land indicators such as rice land, forest land, nature conservation areas, and cultural heritage. As for market indicators, they will be decentralized to localities. That is, land use planning and plans will be both static and dynamic.

In addition, national planning, land use and sectoral planning involving land use must be consistent. For example, land use planning must be consistent with transport and urban planning to orient urban development based on transport routes.

Regarding bidding and auctioning of land use rights, the Government leader said that it is necessary to change the way of thinking and approach in the direction of calculating the overall value of the project for society, not just the amount of money collected after the auction. Because, for the same land plot, bidding and auctioning to build cultural works, hospitals, and schools cannot be the same as for housing projects and commercial centers.

The process and procedures for land acquisition and resettlement also need to be strict to ensure feasibility based on the development of annual land use plans at the district level.

As planned, the draft Land Law (amended) will be completed by the Government, submitted to the National Assembly for consideration and approval at the session in October. As an important draft law, Deputy Prime Minister Tran Hong Ha said that agencies and ministries will absorb and complete this draft law until the "last minute".
