On the afternoon of December 28, in Ho Chi Minh City, the Vietnam International Arbitration Center (VIAC) in collaboration with the University of Economics and Law, Ho Chi Minh City National University organized a workshop on "Developing renewable energy from the perspective of Power Plan VIII: Exploitation from the perspective of legal regulations and practice".
Speaking at the opening of the workshop, Associate Professor Dr. Le Vu Nam, Vice Rector of the University of Economics and Law, stated that renewable energy is considered an inevitable solution and trend of the energy industry in the world. According to the assessment, Vietnam currently has enough renewable energy sources to build a national electricity industry according to the sustainable energy development scenario and the Government is also taking strong directions to promote the development of this type of energy.
However, the legal framework in this field is still in the process of being completed, and in practice, from the investment to the operation stage, many problems arise, especially the risk of disputes between related parties. Therefore, this issue needs to be studied and clarified from both an academic and practical perspective in dispute resolution.
Representative of Vietnam International Arbitration Center (VIAC), lawyer Chau Viet Bac, Deputy Secretary General of VIAC shared some information from the perspective of legal assessment and arising disputes. According to him, the approval of Power Plan VIII helps create a better legal corridor for the implementation and operation of power projects.
For the renewable energy sector, the Power Plan VIII is considered one of the effective tools to promote the development of this sector in the coming time. It is undeniable that the current legal framework for the electricity sector in particular and the energy sector in general still has many shortcomings. Regarding electricity prices and the electricity trading process in recent times, the implementation of the Power Plan VIII has also become more challenging for the business community, investors and competent authorities.
According to VIAC statistics, disputes related to energy projects have recently appeared more and more; mainly in some stages such as: investment, construction, and project operation. Because it is a new field, the legal framework is not yet complete, the rate of disputes in this field may still be high. In that situation, overcoming legal obstacles and creating favorable conditions for businesses to implement projects has become more urgent than ever.
The State and specialized agencies and organizations need to quickly issue institutions and provisions to regulate the energy sector in detail. Along with that, the business community and investors also need to prepare appropriate strategies to adapt to the context until there are regulations to regulate. Together, contribute and advise lawmakers to draft and structure effective provisions, facilitating the investment process and operation of renewable energy projects in general and electricity projects in particular.
