Conference of full-time National Assembly deputies discusses the draft Law on Geology and Minerals

Vice Chairman of the National Assembly Nguyen Duc Hai chaired a discussion session on the draft Law on Geology and Minerals.

Attending the Conference were Minister of Natural Resources and Environment Do Duc Duy and leaders of Departments under the Ministry of Justice and the Ministry of Planning and Investment.

At the 7th session, the National Assembly discussed and commented on the draft Law on Geology and Minerals with 77 comments in groups and 19 comments in the hall. Based on the comments of the National Assembly deputies, the National Assembly Standing Committee directed the examining agency, the drafting agency and relevant agencies to study, absorb and revise the draft law. The Committee on Science, Technology and Environment chaired and coordinated with the Ministry of Natural Resources and Environment, the Standing Committee of the Law Committee to work with VCCI, a number of agencies, National Assembly delegations and a number of localities to organize conferences, workshops, consult experts, managers and affected subjects to complete the draft law.

In addition, the National Assembly Standing Committee gave its opinion on this draft law at the 36th session. Based on the conclusion of the National Assembly Standing Committee, the agencies coordinated to receive and revise the draft law, complete the dossier and bring it to discussion at today's Conference.

At the meeting, Vice Chairman of the National Assembly Nguyen Duc Hai asked the delegates to discuss frankly the issues that they found inadequate, the issues that need to be reviewed to ensure feasibility, focusing on major issues of the draft law, issues that still have many opinions and have 2 contents with 2 different opinions.

Speaking at the meeting, after studying the draft law, delegates highly appreciated the drafting agency and the reviewing agency for their great efforts in absorbing and revising the draft law.

Participating in the drafting of the Law, delegate Duong Khac Mai - Dak Nong informed that from the practical work in the locality, a locality that is currently very entangled in the issue of mineral planning, the delegate proposed to supplement the content of the provisions in Article 14 of the draft Law on Geology and Minerals on the basis of mineral planning as "The current situation of the socio-economic development needs of the locality in the area with potential for planned minerals". According to the delegate, because in the recent past, mineral planning such as bauxite has affected and impacted the socio-economic development of the locality. The planning has not closely followed the development situation, and overlaps with other planning, causing bottlenecks for development.

Delegate Mai proposed to add one more point in the content of mineral planning, which is "assessing the socio-economic and environmental efficiency, comparing costs and benefits between the selection of locations and scale of areas with potential for mineral planning and exploitation compared to the implementation of other socio-economic development projects to serve as a basis for selecting the appropriate scale and area of ​​mineral planning areas".

Regarding the rights and responsibilities of localities and communities where mineral resources and geology are exploited according to Article 9 of the draft law. Delegate Dang Bich Ngoc - Hoa Binh basically agreed with the draft law's additions on the rights and responsibilities of localities, individuals and communities where minerals are exploited. This provision contributes to enhancing people's participation in monitoring mineral exploitation activities.

However, compared to Article 5 of the current law, the draft law does not stipulate the responsibilities of organizations and individuals exploiting minerals, and currently the draft law stipulates the responsibilities of mineral exploitation organizations in environmental protection in Article 62. Delegates proposed to add regulations on the minimum level of support for organizations and individuals exploiting minerals annually for investment costs, upgrading, maintenance, infrastructure construction, and environmental protection in order to further strengthen the responsibilities of organizations exploiting resources and minerals to the localities where mineral exploitation is carried out.

Participate in giving comments on prohibited acts stipulated in Article 10. Clause 6 stipulates “Intentionally destroying geological specimens and rare and valuable minerals”. Delegate Nguyen Thi Suu - Thua Thien Hue analyzed that the phrase “rare and valuable minerals” has not been explained here, what rare and valuable minerals are and what types are included. Therefore, the delegate proposed to add an explanation of the words to Article 3 to ensure consistency and strictness in the process of application in practice, avoiding arbitrary and incorrect application, causing difficulties.

Regarding the content of the Mineral Reserves Assessment Council, Article 55. Delegate Pham Van Hoa - Dong Thap said that this council should be maintained, "because this council is a council established by the state, there has been no assessment for a long time, there is no problem, but suddenly abolishing this council, assigning the council to social activities, I think it is not very good, because mineral resources are national resources, the state has exclusive management, so there needs to be a state council to assess, of course, it must also ensure objectivity" - Delegate Hoa said.

At the same time, the delegate suggested that this council should have many members, even inviting businesses and experts and specialists to participate so that they know how to evaluate the reserves of each type of mineral, how to organize and implement as well as exploit effectively.

Regarding the issue of exploiting group 4 minerals, Article 76 and Article 77 stipulate the registration of group 4 minerals. Delegate Hoa said that this is a new content, a way to reform administrative procedures to simplify the order and administrative procedures compared to the current one, especially this is a group of minerals with simple exploitation technology, with specific characteristics serving important works and projects of the locality. Delegate noted that these types should be assigned to the People's Committee at the provincial level according to their capacity, because according to the proposal of some delegates, when assigned to the People's Committee at the district level, it will not be capable because the Department of Natural Resources and Environment is not enough to advise the People's Committee at the district level, the Department of Natural Resources and Environment will be better.

Concluding the session, Vice Chairman of the National Assembly Nguyen Duc Hai acknowledged that the National Assembly deputies highly appreciated the responsible working spirit of the agency in charge of the review, the agency in charge of the drafting and relevant agencies, and the close direction of the National Assembly Standing Committee to absorb and revise the draft law.

The comments also agreed with many contents that have been received and revised, and also contributed many more opinions to complete the draft law to ensure feasibility, meet practical requirements, and ensure consistency and unity of the legal system.

Vice Chairman of the National Assembly Nguyen Duc Hai said that these are responsible and dedicated opinions that need to be carefully studied to be accepted, explained and persuaded. The National Assembly Standing Committee will coordinate with the Government to direct the agency in charge of the review, the agency in charge of the drafting and relevant agencies to seriously accept the opinions of the National Assembly deputies to continue to complete the draft law and documents in accordance with regulations to submit to the National Assembly for discussion and consideration and approval at the 8th session.
