On behalf of the drafting agency, Minister Dang Quoc Khanh respectfully thanked the National Assembly deputies for contributing many important and valuable comments to the drafting agency in the Law on Geology and Minerals. The drafting agency, together with the reviewing agency, will try to review, absorb, analyze and evaluate the contents that the National Assembly deputies have raised and provided valuable comments to complete and revise the Law on Geology and Minerals to continue reporting to the National Assembly in the next session.
Regarding the opinions discussed at the meeting, Minister Dang Quoc Khanh also discussed some contents to clarify and report further to the National Assembly.
Regarding the issue of mineral classification, many National Assembly deputies are interested, very much in agreement, agreeing with the classification into 4 mineral groups. This will solve the shortcomings of the 2010 Mineral Law because many localities, mineral mining enterprises, rare and valuable mines and soil and rock mines are the same, that is, minerals are currently considered one, so the process and procedures are the same, also assessing reserves, exploration and all procedures and leading to shortcomings in management.
Currently, the draft Law is divided into 4 groups and the delegates basically agree. However, the delegates suggested considering whether groups 3 and 4 are still intertwined, because group 3 is minerals used as construction materials and group 4 is minerals, soil and rock for filling, etc. for filling to implement projects. Therefore, Minister Dang Quoc Khanh said that the comments will be for the drafting agency to review the grouping and classification to make it reasonable and suitable to the practical situation.
Regarding the content group, delegates are concerned about how to manage after decentralization, because in reality, there are decentralizations but the management is not good in localities. Therefore, Minister Dang Quoc Khanh said that after decentralization, sanctions, inspections, and supervision must be increased, and the law has included responsibility, including mine owners and state agencies, to have a system to monitor mining and it has been included in the law.
Minister Dang Quoc Khanh further analyzed that when a mine is allowed to exploit, it is necessary to install a camera system and a 24/7 monitoring system to avoid exploitation outside the mine boundary, exceeding capacity, affecting the environment, and must be connected to the environmental resource management agency at the provincial and ministerial levels.
Minister Dang Quoc Khanh said that this is a content that the drafting agency will accept and try to continue to include in decentralization and delegation of power but associated with supervision.
Regarding the content that delegates are very interested in, it is the management of sand and gravel in riverbeds and lakebeds. Minister Dang Quoc Khanh said that the management will be clearly institutionalized in a separate article to serve socio-economic development but also ensure landslide prevention, environmental protection, and stabilize the lives of people around that area.
Regarding the content of mineral planning that delegates are interested in, Minister Dang Quoc Khanh said that currently, the Ministry of Natural Resources and Environment is assigned the task of conducting basic geological surveys on minerals and is carried out by the Ministry's Geological Federations with a history of nearly 100 years. The survey will comprehensively assess where minerals are dispersed, concentrated, and in scale... providing input data for ministries such as Construction and Industry and Trade to develop sectoral economic plans (such as cement and bauxite).
Therefore, to avoid the problems and problems that have existed in the past, the project of the Law on Geology and Minerals was built to achieve the most synchronization, unity and quality to ensure overcoming the shortcomings of the Law on Minerals (2010), while ensuring synchronization with national planning, sectoral planning and including local planning.
Regarding the content of bidding and auctioning mineral resources, Minister Dang Quoc Khanh said that the most important goal that ministries, branches, localities and enterprises must use the most effective national mineral resources, while ensuring the national mineral strategy and energy security, therefore, the draft Law will be reviewed and these contents will be regulated by the Government to focus on auctioning, ensuring effective exploitation, most effective use and highest revenue.
The Minister also accepted the opinions of the National Assembly deputies who proposed to allocate the state budget for the state to explore reserves and then bid and auction to avoid using socialized resources and enterprise budgets. For group 3 priority minerals, localities should use the budget for exploration, evaluation and then bid and auction to create a transparent and public mechanism. Exploration and evaluation technology must approach modern technology and protect the environment.
For groups of contents on valuation of mineral exploitation rights, mineral reserves, mineral recovery, responsibilities of relevant organizations in mineral exploitation, interpretation of terms related to mineral water, hot water, etc., the drafting agency will clarify and explain to the National Assembly delegates. The Minister also agreed with the delegates that with the contents that are currently inadequate in the decree and circular, if they are specified in the law for implementation as much as possible, the better...
Further information to the National Assembly delegates, this Law project will add a chapter on geology. This is a long-standing science in our country and has a lot of important geological information and data. Because there has been no Law to specify these contents before, the Geology and Minerals Law project is expected to create a national geological database, which will support the development of planning, orientation, and strategy, ensuring a long-term vision. The Minister hopes to continue to receive contributions from National Assembly delegates so that the geological database will serve socio-economic development and long-term strategy in the coming time.
