Support rice exporters to better understand the Law on Competition and Trade Defense

On the morning of June 12, 2024, the National Competition Commission (Ministry of Industry and Trade) chaired and coordinated with the Import-Export Department, the Trade Defense Department, the Legal Department (Ministry of Industry and Trade), with the support of the Vietnam Food Association, the Vietnam Rice Industry Association... to organize a conference to disseminate and popularize laws on competition, trade defense and other relevant regulations for rice export traders.

Accordingly, the conference was held with the aim of implementing the tasks and solutions specified in Directive 10/CT-TTg of the Prime Minister and Directive 03/CT-BCT of the Minister of Industry and Trade, especially the two tasks of promoting market development and trade promotion activities, promoting the circulation and consumption of rice products and inspecting and supervising rice export business activities, ensuring compliance with the provisions of law.

At the conference, speakers from the National Competition Commission, the Department of Trade Remedies, and the Department of Import and Export (Ministry of Industry and Trade) provided businesses with an overview of violations of competition law; practices and trends in foreign trade defense investigations of Vietnamese exports. At the same time, they emphasized the importance of building a healthy and sustainable rice export market.

Speaking at the opening of the Conference, Ms. Nguyen Thi Quynh Nga, Vice President of the National Competition Commission, said that 2023 is a year that has witnessed a series of unusual fluctuations in the food sector in general and the rice market in particular globally. Extreme weather, geopolitical conflicts, inflation, and export restrictions imposed by some countries are factors that have contributed to making the global food market in 2023 more unstable and unpredictable than ever, thereby strongly affecting prices and food security worldwide.

“In such a difficult situation, Vietnam's rice exports in 2023 still achieved positive results. Specifically, our country exported over 8.1 million tons of rice, worth nearly 4.7 billion USD, up 14.4% in volume and 35.3% in value compared to 2022,” Ms. Nguyen Thi Quynh Nga informed.

According to the Vice Chairman of the National Competition Commission, our country's rice industry still has certain shortcomings and limitations. Among them, the limitations include not focusing on developing linkages to build raw material areas as well as implementing solutions on traceability, building a database to meet the requirements of the import market, updating information on the world rice market, forecasting rice import policies of countries; the strategy to diversify export markets is still limited, the rice market shows signs of being unsustainable, still dependent on some traditional markets such as the Philippines, Indonesia, Malaysia; market development has not been supported commensurate with the potential of the industry.

"Through this Conference, the Ministry of Industry and Trade reminds businesses to comply with competition law along with other legal provisions related to rice export business. At the same time, research to respond to the risks of importing countries applying trade defense measures on agricultural, forestry and fishery products (including rice) of Vietnam. Thereby, contributing to increasing the efficiency in building a rice supply chain, developing a healthy and sustainable rice export market, and promptly responding to fluctuations in the region and the world," Ms. Nguyen Thi Quynh Nga expected.

At the conference, Ms. Hoang Thi Thu Trang, Deputy Head of the Competition Investigation Agency (National Competition Commission) also introduced the basic provisions of Vietnam's competition law and some notes for rice trading and exporting enterprises to ensure compliance with competition law.

Next, Mr. Phung Gia Duc, Deputy Head of the Foreign Trade Defense Department (Trade Defense Department) introduced the main contents of the law on trade defense. Along with that were some notes for rice trading and exporting enterprises to ensure compliance with the law on trade defense.

Speaking at the Conference, Mr. Tran Quoc Toan, Deputy Director of the Import-Export Department, said that in the context of slow growth of the world economy and declining total demand, Vietnam's rice export activities continued to overcome difficulties and recorded some positive results. " According to the estimated data of the inter-ministerial committee, rice export in the first 5 months of 2024 reached about 4.15 million tons, up 14.7% in volume; value reached 2.65 billion USD, up 38.2% in value. The average export price was 638 USD/ton, up 20.5% in price compared to the estimated implementation in the first 5 months of 2023 ".

According to the Deputy Director of the Import-Export Department, to achieve such results, it is the close direction of the Government, Ministries, branches, and localities, in which it is impossible not to mention the efforts of rice export traders that have contributed to creating the above encouraging results. However, the current legal document system governing rice export business still has some inappropriate points, not keeping up with the arising reality, but is relatively complete and comprehensive, contributing to helping state management agencies and traders create a bright picture in the export sky of Vietnam in the recent past.

Also at this Conference, Mr. Tran Quoc Toan also presented some key points in Decree 107/2018/ND-CP on rice export business. In particular, special attention was paid to enterprises on the conditions for rice export business and the issuance of Certificates of eligibility for rice export business; application documents for Certificate issuance; regulations on post-inspection of rice export business conditions; regulations on the responsibilities of traders.

“Up to now, the above Decree has been implemented for 7 years and has had a positive impact on rice export business activities. The Decree has encouraged traders of all economic sectors to participate in rice export when they meet the conditions for rice export business and are granted a Certificate of eligibility for rice export business. The number of rice export traders is currently about 158; the capacity of warehouses, milling, grinding, and processing of paddy and rice has been significantly improved, meeting the production and business needs of traders, contributing to fundamentally solving a number of shortcomings and problems in purchasing, consuming paddy and rice, preliminary processing, and processing of paddy products...” , Mr. Toan shared more.
