What authority will the two new cities that are about to form in Hanoi have?

The draft revised Law on the Capital is being discussed and commented on by the National Assembly at its 6th session. On November 10, this draft was discussed by National Assembly deputies in a group discussion session with 81 comments and 2 written comments.

Authority of "2 future cities"

The report of the Secretary General of the National Assembly summarizing opinions at the group discussion session showed that there were many opinions of concern about the city government of Hanoi city.

Some opinions say that the provisions in the draft Law on the Capital have not yet reflected specific policies to promote the role of the city government model within the city.

Besides, there are opinions that the regulation on the authority of the city to organize the recruitment of civil servants is unnecessary because it has been stipulated in the Law on Organization of Local Government.

Explaining this content, Minister of Justice Le Thanh Long said that according to Resolution 15 of the Central Committee, in the coming time, Hanoi is expected to form 2 cities within the city.

One city is located in the North of Hanoi, including Me Linh, Soc Son, Dong Anh areas; and one city is located in the West, including Xuan Mai, Hoa Lac areas.

In order to create an initial legal basis for these cities when they are established, Minister of Justice Le Thanh Long said that the draft Law has stipulated a number of specific authorities (decentralized from the authority of the People's Council and People's Committee of the City) for the People's Council and People's Committee of the city of Hanoi.

First of all, it is the authority to decide on the establishment, reorganization, and dissolution of a number of specialized agencies, administrative organizations, and special public service units under the People's Committee of Hanoi city.

Second is the authority to regulate a number of tasks and powers of specialized agencies and other administrative organizations under the People's Committee of Hanoi city.

Third, the two cities under Hanoi are about to be formed, and it is decided to establish, reorganize, and dissolve public service units under the management of the People's Committee of Hanoi city.

The two new units, when established, will also have the authority to organize the recruitment of civil servants for agencies and organizations under the city of Hanoi, according to the Minister of Justice.

Reviewing regulations on decentralization for Hanoi to adjust local planning

Regarding the planning of construction and development of the capital, Minister Le Thanh Long said there was a proposal to consider decentralizing the authority for Hanoi city to locally adjust the general urban planning, the general planning of functional area construction, and specialized planning of technical infrastructure.

The reason is that in Hanoi city, there are headquarters of many central agencies, so they need to be managed, controlled and coordinated by the Prime Minister .

The Minister of Justice explained that the provisions in the draft Law aim to create proactive conditions for the Hanoi People's Committee to locally adjust the general urban planning, general planning for the construction of functional areas, and specialized technical infrastructure planning approved by the Prime Minister.

According to the explanation of the drafting agency, the work of establishing, appraising and approving construction plans of localities often takes several years, creating a certain delay compared to the trends, goals, orientations and development practices of the locality.

Although all plans have forecasts and calculations, they are mainly at the macro level. The planning implementation process may need local adjustments to suit objective reality, provided that the planning targets and orientations are not violated.

Besides, when implementing local planning adjustment procedures, it is still necessary to establish, appraise and approve, which will create delays in planning implementation.

Therefore, the draft Law stipulates that the Hanoi People's Committee decides to adjust local planning and reports the implementation results to the Prime Minister.

"However, to ensure the Prime Minister's management, control and coordination, especially in important areas with many headquarters of central agencies, the drafting agency will continue to research and review to make appropriate regulations," Minister Le Thanh Long stated.

The draft revised Law on the Capital consists of 7 chapters and 59 articles, and is expected to be considered and approved by the National Assembly at the mid-2024 session.
