Adjusted to reduce 13 projects with a total area of over 52 hectares
This is one of the contents in the Resolution of the City People's Council recently passed at the 17th Session on Adjusting and supplementing the list of land acquisition projects and works in 2024; the list of projects to change the purpose of rice-growing land in 2024 in Hanoi.
Accordingly, the Resolution of the Hanoi People's Council has decided to adjust down the projects identified in Resolution No. 34/NQ-HDND dated December 6, 2023 (adjusted and supplemented in Resolution No. 05/NQ-HDND dated March 29, 2024) of the City People's Council: 13 projects with a total recovered land area of 52.51 hectares.
Adjust and supplement the contents of land recovery projects identified in Resolution No. 34/NQ-HDND dated December 6, 2023 (adjusted and supplemented in Resolution No. 05/NQ-HDND dated March 29, 2024) of the City People's Council as follows: Adjust to increase the recovered land area at 26 projects with a total area of 20.5 hectares; adjust to decrease the recovered land area at 9 projects with a total area of 57.0 hectares; adjust the project name, registered unit, and commune-level location of the project implementation (without changing the recovered land area) at 17 projects.
The City People's Council also added a list of 201 land acquisition projects in 2024 with a total area of 804.32 hectares; added a list of 21 projects to convert rice-growing land purposes with a total area of 29,002 hectares.
Regarding the budget for compensation and site clearance, based on the list of projects approved by the City People's Council, the Resolution clearly states: for projects using the city budget capital included in the city's public investment plan, it is balanced in the Resolution on allocating the city budget estimate for 2024 of the City People's Council. Projects under the budget of districts, towns and cities are arranged by districts, towns and cities. Projects outside the budget are arranged by investors according to the investment progress, ensuring sufficient funding for site clearance in 2024.
Supplementing the list of land acquisition projects to ensure implementation capability
According to the Report of the Hanoi People's Committee, in Resolutions No. 34/NQ-HDND dated December 6, 2023 of the City People's Council and Resolution No. 05/NQ-HDND dated March 29, 2024, the City People's Council approved a list of 3,056 land recovery projects in 2024 with a total area of 13,671.81 hectares; approved a list of 30 projects to change the purpose of rice-growing land with a total area of 65.8848 hectares; approved 1 project to change the purpose of protective forest land with an area of 0.3687 hectares. By June 30, 2024, the results of land recovery, land allocation, land lease, and land use purpose conversion were about 1,714 projects with a total area of 7,061.82 hectares (reaching 56.1% of the plan).
Based on the registered needs of 26 districts, towns and cities and related legal basis, the districts proposed to adjust down 13 projects with a total recovered land area of 52.51 hectares because some projects at the district level in 2024 are not prioritized for capital allocation; or must go through procedures to review planning and adjust investment projects and construction planning.
Regarding the proposal to increase the area of recovered land in 26 projects with a total area of 20.5 hectares and to decrease the area of recovered land in 9 projects with a total area of 57.0 hectares, the reason given was that during the process of researching and establishing investment projects, the District People's Committee conducted a preliminary survey and estimated the area and type of recovered land, so there was no accuracy in the records and current status. After having a record of determining the boundary for site clearance, the District People's Committee conducted an investigation, survey and inventory, thereby accurately providing information on the area and type of land for project implementation. In addition, at present, there are a number of projects that have been approved by competent authorities for investment policies, approved investment projects or adjusted, including adjustments in land use scale.
Regarding the adjustment of project name, registered unit, commune-level location of project implementation (without changing the recovered land area) at 17 projects, the stated reason is according to the Decision on adjusting investment policy, approving investment project approved by competent authority or supplementing commune-level location when implementing land recovery.
The districts also said that due to the need to use land for local socio-economic development, the addition of the project list is to ensure the ability to implement in 2024. Therefore, the districts have proposed to add a list of 201 land acquisition projects in 2024 with a total area of 804.32 hectares.
At the same time, based on the need to change the purpose of using rice-growing land to implement the project, the need for socio-economic development as well as the proposals of 18 districts and towns, the City People's Committee submitted to the City People's Council for approval the list of adjustments and additions to 21 projects to change the purpose of using rice-growing land in 2024 with a total area of 29,002 hectares to implement the project.
Prioritize implementation according to the urgency of each project .
The City People's Council assigned the City People's Committee to organize the implementation of the Resolution; continue to effectively implement the tasks and solutions of the City People's Council in Article 2 of Resolution No. 34/NQ-HDND dated December 6, 2023: Only carry out land recovery and change of land use purpose when ensuring full procedures, processes and compliance with legal regulations. During the implementation process, the City People's Committee continues to review the scale and area of each project, evaluate the implementation progress, and arrange the order of priority according to the urgency of each project, ensuring the goal of effective and economical land use. After recovery, investors are required to put the land into effective use as soon as possible. Resolutely handle projects that are slow to implement and violate the Land Law according to regulations.
In case of a request to use land to implement important and urgent works and projects for national and public interests that are not yet included in the list approved by the City People's Council or in case of need for adjustment, the City People's Committee shall synthesize and submit to the City People's Council at the meetings in 2024.
Continue to do a good job of propaganda, publicity and transparency to create consensus among people, especially in areas where land is recovered. Correctly implement regulations on compensation and resettlement support for organizations and individuals whose land is recovered, ensuring that people have a better life or the same as their old place of residence.
