As reported by VietNamNet , singer Phuong My Chi said she sent a complaint to the Ministry of Public Security 's authorities after rumors of a sensitive clip being leaked.
"From a technology expert's perspective, it is determined that this clip was manipulated using deepfake technology. And not only me, but many famous people in the world have fallen into similar situations. More commonly, fraudulent video calls now also use this technology," said the female singer.
Speaking with VietNamNet reporter, Dr. and lawyer Dang Van Cuong said that the female singer's complaint is the basis for the authorities to clarify the truth of the matter.
The act of disseminating other people's private information on cyberspace, causing serious impacts on the lives, psychology and health of others, can be criminally prosecuted for the crime of illegally providing information on the Internet according to Article 288 of the Penal Code, the crime of Slander according to Article 156 of the Penal Code, the crime of Humiliating others according to Article 155 of the Penal Code or other crimes according to the provisions of law related to information technology, frequencies and radio.
Lawyers analyzed that Vietnamese law strictly prohibits the act of disseminating obscene cultural products. Posting sex clips, images, clips that arouse sexual desire, negatively affect security, order, social safety, go against good customs, spread a decadent and hedonistic lifestyle are also acts that violate the law, and those who disseminate obscene cultural products can be prosecuted.
Normally, when sex clips are spread on social networks, the number of people accessing the information is very large. In case there is evidence that this is an obscene clip, has a capacity of 1GB or more, or is accessed by 10 or more people, the person who spreads this sex clip will be criminally prosecuted for the crime of Disseminating obscene cultural products, regardless of whether that person is the owner of the clip or not.
In case the act is determined to be disseminating obscene cultural products and the cultural products are edited, staged or use deepfake technology to create videos with the purpose of insulting the honor and dignity of others, the person who commits this act will also be prosecuted for the crime of Slander under Article 156 of the Penal Code.
According to the lawyer, the crime of Insulting others and the crime of Slander require a request from the victim. As for the act of disseminating obscene cultural products, there is no need for a request from the victim, the investigation agency can also verify and clarify to handle according to the provisions of the law.
Currently, the singer has filed a report, so the investigation agency will process the report and verify it within two months, with a possible extension of no more than two months. At the end of this period, the investigation agency will decide whether or not to prosecute the criminal case for the crime of Disseminating obscene cultural products, the crime of Slander, the crime of Humiliating others..., depending on the results of the verification.
"This is a complicated case, related to the honor, dignity and reputation of an individual, and also related to network security. Therefore, the authorities will be cautious in receiving information, verifying and considering handling it according to the provisions of the law," said Dr. Dang Van Cuong.
