Who do teachers need permission from to teach outside of school?

In addition to regular teaching and extra teaching at school, many teachers also participate in extra teaching outside to increase their income.

In order to ensure increased responsibility of schools in managing tutoring teachers, the Ministry of Education and Training has just issued Circular 29/2024 replacing Circular 17/2012/TT-BGDDT.

Notably, the content of the new Circular clarifies the regulations on extra-curricular teaching and learning activities outside of school compared to the old regulations. So, do teachers who are receiving salaries from the salary fund of public service units need to ask for permission from anyone when teaching extra-curricular activities outside?

Do teachers need permission to teach outside of school?

Regarding extra-curricular teaching and learning activities, Article 6 of Circular 29/2024 stipulates each specific case and requires full implementation.

Accordingly, organizations or individuals organizing extra-curricular teaching and learning activities outside of school that collect fees from students must register their business according to the provisions of law. Publicize the subjects for which extra-curricular teaching is organized; the duration of extra-curricular teaching for each subject according to each grade level; the location, form, and time of extra-curricular teaching and learning; the list of extra-curricular teachers and the amount of tuition collected before enrolling students for extra-curricular teaching and learning classes.

Extracurricular tutors must ensure good moral qualities and professional competence appropriate to the subject they teach.

Teachers who are teaching at schools and participate in extra-curricular teaching must report to the Principal or Director or head of the school about the subjects, location, form, and time of extra-curricular teaching.

Thus, teachers who are receiving salaries from the salary fund of public service units and want to teach extra classes outside of school must report to the Principal or Director or head of the school. Meanwhile, the old circular did not clearly state whether teachers teaching extra classes outside of school need to ask for permission from the head or not.

Cases where extra teaching and extra teaching are not allowed

Article 3 of Circular 29 stipulates that extra teaching and learning can only be organized when students have the need to learn extra and have the consent of their parents or guardians. Schools, organizations, and individuals organizing extra teaching and learning must not use any form to force students to learn extra.

The content of extra teaching and learning must not be contrary to the provisions of Vietnamese law and must not contain prejudices about ethnicity, religion, occupation, gender, or social status. The content of teaching according to the school's educational plan must not be reduced to include extra teaching.

Extra teaching and learning must contribute to developing students' qualities and abilities; must not affect the organization and implementation of the school's educational program and the implementation of teachers' subject programs.

The duration, time, location and form of organization of extra teaching and learning must be suitable for the psychology and age of the students, ensuring the health of the students; comply with the provisions of law on working hours, overtime hours and the provisions of law on security, order, safety, environmental sanitation, fire prevention and fighting in the area where extra teaching and learning classes are held.
