Lilama Company Director brings 5 ​​billion VND to 'thank' Former Lao Cai Provincial Party Secretary on Lunar New Year

On July 15, news reported that the Investigation Police Agency of Lao Cai Province Police had just completed the investigation conclusion, proposing to prosecute 15 defendants in the case of illegal mining of millions of tons of coal, which occurred in the area.

Among them, defendant Nguyen Van Vinh - former Secretary of Lao Cai Provincial Party Committee and defendant Doan Van Huong - former Chairman of Lao Cai Provincial People's Committee were proposed to be prosecuted for the crime of abusing position and power while performing official duties.

Defendant Nguyen Manh Thua, Director of Lilama Company, was proposed to be prosecuted for two crimes: money laundering and violating regulations on research, exploration and exploitation of resources.

According to the case file, in 2009, Lilama Company was granted a certificate by the People's Committee of Lao Cai province to carry out an investment project to build a hotel and restaurant in village 2 (Dong Tuyen commune, Lao Cai city, Lao Cai province) on a land area of ​​3.77 hectares.

Because part of the area overlaps with the apatite ore planning project, the Provincial People's Committee revoked the land certificate of the above land area and assigned it to Apatite Vietnam Company for management and use.

After that, Apatite Vietnam Company hired Lilama Company to exploit more than 167,000 tons of ore. By May 2012, Lilama Company sent a document to Lao Cai Provincial People's Committee, requesting to hand over the land area of ​​3.77 hectares and re-issue the investment certificate for the restaurant and hotel project, and was approved.

In May 2013, Lao Cai Provincial People's Committee continued to issue a document stating that "if the analysis results detect ore (including poor ore), it will be assigned to Lilama Company for collection, and agreed with Vietnam Apatite Company to gather, manage, and use according to legal regulations".

However, Lilama Company Director Nguyen Manh Thua then directed his staff and hired other units to bring machinery into the land to illegally mine ore. The mined ore was sold by Lilama Company to Vietnam Apatite Company and several chemical companies.

According to the investigation, the amount of apatite ore that Lilama Company leased to Apatite Vietnam Company and directly exploited was up to more than 1.5 million tons, worth more than 610 billion VND. Lilama Company earned more than 484 billion VND, Apatite Vietnam Company also benefited more than 184 billion VND.

The investigation agency alleged that, when he was Vice Chairman and Chairman of the People's Committee of Lao Cai province, defendant Vinh was primarily responsible for the management and protection of mineral resources in the province, knowing clearly that the area of ​​3.77 hectares belonging to mining site 18 had been approved by the Ministry of Industry and Trade for apatite ore planning, and the authority to grant mining licenses belonged to the Ministry of Natural Resources and Environment.

However, defendant Vinh signed the investment certificate and many other related documents and papers without proper authority and against the law, leading to Lilama Company and Vietnam Apatite Company illegally exploiting and consuming a huge amount of apatite ore.

Defendant Vinh's violations were systematic and directed throughout, because for this same project, the defendant signed the investment certificate to build a hotel, and when he knew there were large mineral reserves, he signed the decision to revoke them, then re-granted the exact area of ​​land that had been revoked to Lilama Company to invest in building a hotel and to collect all the minerals.

Although Vietnam Apatite Company repeatedly requested not to grant the 3.77 ha land area to Lilama Company, when the subordinates presented documents that were not in accordance with the law, defendant Vinh did not prevent or direct departments and branches to take measures to manage and protect mineral resources in accordance with the law.

Defendant Vinh signed illegal documents, creating conditions for Lilama Company and Vietnam Apatite Company to illegally exploit and consume ore. On the eve of Lunar New Year 2015, defendant Nguyen Manh Thua brought 5 billion VND to give defendant Nguyen Van Vinh as a thank you.
