Provincial National Assembly Delegation: Collecting comments on the draft Law amending and supplementing a number of articles of the Law on Property Auction

On October 2, the National Assembly Delegation of the province held a conference to collect comments on the draft Law amending and supplementing a number of articles of the Law on Property Auction (DGTS), expected to be submitted to the National Assembly for comments at the 6th session of the 15th National Assembly. Comrade Dang Thi My Huong, Deputy Head of the National Assembly Delegation of the province chaired the conference.

The Law amends and supplements a number of articles of the Law on Property Auction to continue institutionalizing the Party's guidelines and policies, the State's policies and laws on developing property auction services according to the socialist-oriented market mechanism; preventing and combating corruption, negativity and waste; continuing to improve the professionalism and specialization of the auctioneer team, property auction organizations, and the quality of property auction activities; overcoming limitations and shortcomings, ensuring publicity, transparency and objectivity; promoting the application of information technology and digital transformation; improving the efficiency and effectiveness of state management of property auctions. The draft Law amends and supplements 25 articles and clauses; adds 01 new Article, closely following the guiding viewpoint on building the Law on Property Auction as a formal law, regulating the order and procedures for auctions applied uniformly to assets that the law stipulates must be sold through auctions; Basically maintain the provisions of the Law that are still relevant and effective in practice.

Comrade Dang Thi My Huong, Deputy Head of the National Assembly Delegation of the province, spoke at the conference.

At the conference, delegates basically agreed with the content of the draft law and gave additional comments on the following issues: Consider simplifying procedures for property auctions to suit the current digital transformation and administrative reform; propose to review and develop strict regulations on cases of force majeure in not attending auctions; need to have 2 supervisors instead of 1 person to ensure objectivity and avoid collusion between bidders and auction organizations; need to have regulations on the deposit level for different types of assets, at least 8-10% and for land use rights at least 15% of the starting price; no need to confirm the listing of property auctions in the locality; need to have a direction for handling auction participants who deposit money in advance; strengthen inspection, examination and handling of violations in property auction activities...

On behalf of the National Assembly delegation, the Deputy Head of the Provincial National Assembly Delegation acknowledged and highly appreciated the opinions of the delegates; at the same time, he will synthesize them to submit to the National Assembly in the coming time.
