Evacuate people from old apartments to ensure safety during the storm season

The Ministry of Construction has just sent Official Dispatch 5297/BXD-QLN requesting the People's Committees of provinces and centrally run cities to implement the Housing Law 2023 and Decree No. 98/2024/ND-CP of the Government on renovation and reconstruction of apartment buildings.
The Ministry of Construction informed that many northern provinces have been and are being heavily affected by storm No. 3, causing floods and damage to people and property in many localities. Through inspection after storm No. 3, many old apartment buildings that need to be renovated and rebuilt in localities have cracks, tilts, and are unsafe due to the impact of storms and floods, requiring people to be evacuated from the apartment buildings to ensure safety. According to statistics, the whole country has about 2,500 old apartment buildings built before 1994, mainly concentrated in Hanoi and Ho Chi Minh City, including many apartment buildings that, according to inspection results, need to be urgently renovated and rebuilt.

Implementing the Housing Law No. 27/2023/QH15 (effective from August 1, 2024), which stipulates many new and specific policies and mechanisms related to the renovation and reconstruction of apartment buildings and Decree No. 98/2024/ND-CP dated July 25, 2024 detailing a number of articles of the Housing Law on renovation and reconstruction of apartment buildings, to ensure the safety of life and property of people living in old apartment buildings before and during the 2024 storm season; to speed up renovation and reconstruction projects of apartment buildings, the Ministry of Construction requests the People's Committees of provinces and centrally run cities to urgently relocate people from old, dangerous and degraded apartment buildings that must be demolished according to regulations and arrange temporary accommodation for households that must be relocated. In addition, localities urgently inspect and evaluate the quality of old apartment buildings; Apartment buildings that have been inspected and are subject to renovation and reconstruction, but have not yet been included in the construction plan, need to make plans according to the provisions of the 2023 Housing Law and Decree No. 98/2024/ND, as a basis for implementing renovation and reconstruction projects; at the same time, approve the 1/500 scale planning of areas with apartment buildings that need to be renovated and reconstructed so that investors have a basis to participate in developing investment plans, compensation, resettlement support, etc.
The determination of the apartment area compensation coefficient applicable to each area and locality with apartment buildings built before 1994 that need to be renovated or rebuilt needs to be agreed upon by the locality soon to be included in the compensation and resettlement plan. For Hanoi and Ho Chi Minh City, there are many old apartment buildings that need to be renovated or rebuilt, especially apartment building renovation and reconstruction projects that were implemented before the 2023 Housing Law took effect, but to date, the procedures for approving compensation, support and resettlement plans; land allocation, land lease, issuance of construction permits, etc. need to be urgently completed for investors to promptly deploy urgent project construction and resettlement arrangements for people.
