Proposal to change the classification of driving licenses

The Ministry of Public Security is seeking comments on the Draft Law on Road Traffic Order and Safety, which includes a proposal to change the classification of driving licenses compared to the provisions of the 2008 Road Traffic Law.

Ministry of Public Security proposes new classification of driving licenses

Specifically, in Article 39 of the draft Law on Road Traffic Safety and Order, driving licenses will be reclassified as follows:

(1) Class A2 is granted to drivers of two-wheeled motorbikes with a cylinder capacity from 50 cm3 to 175 cm3 or an engine with equivalent rated capacity;

(2) Class A is granted to drivers of two-wheeled motorbikes with a cylinder capacity of 175 cm3 or more or engines with equivalent rated capacity and types of vehicles specified for class A2 driving licenses;

(3) Class A3 is granted to drivers of three-wheeled motorbikes and other types of vehicles specified for class A2 driving licenses;

(4) Class B is granted to drivers of passenger cars with up to 9 seats (including the driver's seat); trucks (including specialized trucks), tractors with a designed cargo weight not exceeding 3,500 kg; types of cars specified for Class B driving licenses with trailers attached with a total designed weight of the trailer not exceeding 750 kg; types of vehicles specified for Class B2 driving licenses;

(5) Class C1 is granted to drivers of trucks (including specialized trucks and specialized cars), tractors with a designed cargo weight of over 3,500 to 7,500 kg; types of trucks specified for Class C1 driving licenses with trailers attached with a total designed weight of the trailer not exceeding 750 kg; types of vehicles specified for Class B driving licenses;

(6) Class C is granted to drivers of trucks (including specialized trucks and specialized cars), tractors with a designed cargo weight of over 7,500 kg; types of trucks specified for Class C driving licenses with trailers attached with a total designed weight of the trailer not exceeding 750 kg; types of vehicles specified for Class B and C1 driving licenses;

(7) Class D2 is granted to drivers of passenger cars (including buses) with 10 to 30 seats; types of passenger cars specified for class D2 driving licenses with trailers attached with a total designed weight of the trailer not exceeding 750kg; types of vehicles specified for classes B, C1, C driving licenses;

(8) Class D is granted to drivers of passenger cars (including buses) with more than 30 seats; sleeper cars; types of passenger cars specified for class D driving licenses with trailers attached with a total designed weight of the trailer not exceeding 750kg; types of vehicles specified for classes B, C1, C, D2 driving licenses;

(9) Class BE is granted to drivers to drive types of cars specified for class B driving licenses when towing trailers with a total designed weight of the trailer over 750 kg;

(10) Class C1E is granted to drivers to drive the types of cars specified for class C1 driving licenses when towing trailers with a total designed weight of the trailer over 750 kg;

(11) Class CE is granted to drivers to drive types of cars specified for class C driving license when pulling trailers with a total designed weight of the trailer over 750 kg; tractors pulling semi-trailers;

(12) Class D2E is granted to drivers to drive the types of cars specified for class D2 driving license when towing a trailer with a total designed weight of the trailer over 750 kg;

(13) Class DE is granted to drivers to drive the types of cars specified for class D driving licenses when towing trailers with a total designed weight of the trailer over 750 kg.

For disabled people driving three-wheeled motorbikes for disabled people, a class A2 driving license is issued.

Disabled people driving cars with control mechanisms suitable for their disability are granted a class B driver's license.

In case the vehicle is designed or modified to have fewer seats than a vehicle of the same type and equivalent size limit, the driving license class will be calculated according to the vehicle of the same type and equivalent size limit.

Thus, compared to the current 2008 Road Traffic Law, the draft Law will no longer have driver's licenses for classes A1, A4, B1, B2, E, FB2, FD, FE, FC.

How will driving licenses be changed and reissued according to the new classification according to the Draft?

Specifically, the draft Law on Road Traffic Safety stipulates that driving licenses issued under the 2008 Road Traffic Law can continue to be used. In the cases specified in Clause 2 (Reissued driving licenses), 3 (Exchanged driving licenses) Article 43 of the draft Law, they can be changed or reissued according to the new classification.

Accordingly, driving licenses of classes A1, A2, A3, B1, B2, C, D, E, FB2, FC, FD, FE issued under the 2008 Road Traffic Law are changed and reissued as follows:

- Class A3 and C driving licenses remain the same and can be changed or reissued with the same class;

- Class A2 driving license is exchanged or reissued to those who have class A1 driving license;

- Class A driving license is exchanged or reissued to those who have a class A2 driving license;

- Class B driving license is exchanged or reissued to those who have class B1 and B2 driving licenses;

- Class D2 driving license is exchanged or reissued to those who have a Class D driving license;

- Class D driving license is exchanged or reissued to those who have Class E driving license;

- BE class driving license is exchanged and reissued to those who have FB2 class driving license;

- CE class driving license is exchanged and reissued to those who have FC driving license;

- Class D2E driving license is exchanged and reissued to those who have class FD driving license;

- DE class driving license is exchanged and reissued to those who have FE class driving license.
