Kinhtedothi - On the morning of February 12, at the 9th extraordinary session of the 15th National Assembly, Secretary General of the National Assembly and Head of the National Assembly Office Le Quang Tung presented the Report of the National Assembly Standing Committee on the Draft Law amending and supplementing a number of articles of the Law on Organization of the National Assembly.
The organs of the National Assembly have three functions.
Secretary General and Head of the Office of the National Assembly Le Quang Tung said that based on the purpose, guiding viewpoints and results of the review of the Law on Organization of the National Assembly, the Standing Committee of the National Assembly proposed the scope of amendments and supplements to the Law on Organization of the National Assembly focusing on the following contents: amending and supplementing regulations on the Council of Nationalities and Committees of the National Assembly; amending and supplementing regulations on the Secretary General of the National Assembly, the Office of the National Assembly, and agencies under the Standing Committee of the National Assembly.
Adjusting a number of contents related to the division of authority between the National Assembly, the National Assembly Standing Committee and the authority of the Government and other State agencies. At the same time, combining amendments and supplements to a number of articles and clauses related to the activities of the National Assembly, the National Assembly Standing Committee, the National Assembly agencies and National Assembly deputies, which, through the summary of practical activities from 2016 to present, have arisen problems and inadequacies.
The Draft Law focuses on 35/102 articles of the current Law on Organization of the National Assembly. The amended and supplemented contents are arranged in 2 articles, Article 1 amends and supplements 18 articles and abolishes 17 articles of the Law on Organization of the National Assembly; Article 2 stipulates the effective date.
Regarding the division of authority between the National Assembly, the Government and agencies in the State apparatus, the Draft Law amends and supplements the provisions in Article 5 of the Law on the Organization of the National Assembly to clarify the scope of contents that need to be regulated by law, resolutions of the National Assembly and regulations of principles and orientations on the level of detail that needs to be regulated in law. The division of authority between the National Assembly and other State agencies in each specific field will continue to be clarified and specified in laws and resolutions regulating each specialized field.
The draft Law amends and supplements the provisions on the National Assembly's agencies (Chapter IV of the Law on the Organization of the National Assembly) in the direction of continuing to affirm that the Council of Nationalities and the Committees of the National Assembly are agencies of the National Assembly; the number and names of the Committees are decided by the National Assembly; stipulates the basic functions of the National Assembly's agencies focusing on the three contents of examination - supervision - recommendation; and provides general provisions on the organizational structure and working principles of the Council of Nationalities and the Committees of the National Assembly.
Amending and supplementing regulations on the Secretary General of the National Assembly, the Office of the National Assembly, and agencies under the Standing Committee of the National Assembly (Articles 98, 99, and 100 of the Law on Organization of the National Assembly) in accordance with Conclusion No. 111-KL/TW of the Politburo, such as: determining that the Secretary General of the National Assembly is also the Head of the Office of the National Assembly; not regulating the Deputy Secretary General, the Secretariat, and agencies of the Standing Committee of the National Assembly.
The draft Law also amends and supplements a number of provisions related to the activities of the National Assembly, the National Assembly Standing Committee, the National Assembly agencies and National Assembly deputies (Articles 12, 13, 30, 39, 48 of the Law on Organization of the National Assembly) such as: the National Assembly taking a vote of confidence, voting for confidence in people holding positions elected or approved by the National Assembly; the participation of National Assembly deputies as members and participating in the activities of the National Assembly Council and Committees; cases of temporary suspension of the performance of duties, powers of National Assembly deputies and the authority of the National Assembly Standing Committee in drafting laws, ordinances, resolutions, and on the National Assembly's operating budget.
Basically distinguish the authority of the National Assembly with the Government and other agencies.
Presenting the Review Report on the Draft Law, Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that the Law Committee agreed with the necessity of promulgation, the scope of amendments and supplements, and the basic contents of the draft Law amending and supplementing a number of articles of the Law on Organization of the National Assembly as stated in the Submission of the National Assembly Standing Committee.
The Law Committee agrees with the amendment of the provisions on law making and law amendment in Article 5 of the Law on Organization of the National Assembly and finds that the provisions in the Draft Law have basically distinguished the authority of the National Assembly with the Government and other agencies in the State apparatus, meeting the requirements and directions of the Central Committee and the Politburo.
Regarding the Council of Nationalities and the Committees of the National Assembly (Articles 66, 67 and 68a), the Law Committee agrees that the Draft Law only provides general regulations on the functions, tasks, powers and organizational structure of the Council of Nationalities and the Committees of the National Assembly. The establishment of each specific Committee is decided by the National Assembly based on the policy of arranging and streamlining the State apparatus in each period to ensure the stability and longevity of the Law.
The Law Committee agrees to amend and supplement regulations on the Secretary General of the National Assembly, the Office of the National Assembly, and agencies under the Standing Committee of the National Assembly as in the Draft Law.
"The lack of regulations on the Deputy Secretary General, the Secretariat and agencies under the National Assembly Standing Committee in the Law on Organization of the National Assembly is aimed at institutionalizing the policy on arranging and streamlining the state apparatus in Conclusion No. 111-KL/TW of the Politburo," the Chairman of the Law Committee stated.
After listening to the Report and the verification report, on the morning of February 12, National Assembly deputies discussed in groups the Draft Law amending and supplementing a number of articles of the Law on Organization of the National Assembly.
