Kinhtedothi - On the morning of February 18, continuing the working program of the 9th Extraordinary Session, the 15th National Assembly unanimously passed the Law on Government Organization (amended) consisting of 5 chapters and 32 articles, highlighting the role and tasks of the Prime Minister in leadership and direction.
Accordingly, the Law stipulates that the Government is the highest State administrative body of the Socialist Republic of Vietnam, exercises executive power, and is the executive body of the National Assembly. The Government is responsible to the National Assembly and reports on its work to the National Assembly, the National Assembly Standing Committee, and the President.
The Government consists of the Prime Minister, Deputy Prime Ministers, Ministers and Heads of ministerial-level agencies. The number of Government members is decided by the Prime Minister and submitted to the National Assembly for decision.

The Government organizes a multi-sectoral, multi-field administrative management apparatus that is streamlined, efficient, effective, and efficient; ensuring the principle that lower-level agencies submit to the leadership, direction, and strictly comply with the decisions of higher-level agencies.
The Law clearly defines the tasks, powers and responsibilities between the Government, the Prime Minister and Ministers, Heads of ministerial-level agencies and the functions and scope of management between Ministries and ministerial-level agencies; ensures the principle of collective leadership, individual responsibility, and promotes the personal responsibility of the head.
Regarding the duties and powers of the Prime Minister, the Law stipulates that in cases of real necessity for the national interest, prevention and control of natural disasters and epidemics, and to ensure the lives and property of the People, the Prime Minister shall decide to apply other urgent measures prescribed by current laws and report to the competent agencies of the Party and the National Assembly as soon as possible.
The Prime Minister also submits to the National Assembly for approval proposals to appoint, dismiss, or remove Deputy Prime Ministers, Ministers, and Heads of ministerial-level agencies. During the period when the National Assembly is not in session, submits to the President for decision to temporarily suspend the work of Deputy Prime Ministers, Ministers, and Heads of ministerial-level agencies.
Regarding the form of operation of the Government, the Law stipulates that the Government holds regular meetings once a month; thematic meetings, meetings to resolve urgent matters according to the decision of the Prime Minister, at the request of the President or of at least 1/3 of the total number of Government members.
In case the Government does not meet, the Prime Minister decides to send written opinions to the Government members. The Government meets at the request of the President to discuss issues that the President considers necessary to perform the duties and powers of the President...
The amended Law on Government Organization takes effect from March 1, 2025.
Previously, presenting a report explaining, accepting and revising the Draft Law on Government Organization (amended), Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that the Law clearly defines the tasks, powers and authority of the Prime Minister to comply with the provisions of the Constitution and laws and be responsible for the operations of the State administrative system from the central to local levels. Accordingly, it highlights the Prime Minister's tasks in leading, directing and operating the activities of the Government.
The new point in the regulations on the tasks and powers of the Government is that the Government unifies the State management of sectors and fields. The Government assigns the scope of State management to ministries and ministerial-level agencies; decentralizes authority to Ministers and Heads of ministerial-level agencies according to the scope of management, ensuring clear division of responsibilities of Ministers and Heads of ministerial-level agencies as members of the Government and heads of ministries and ministerial-level agencies.
At the same time, the Government decides on policies for the development of sectors, regions and localities, except for policies under the decision-making authority of the National Assembly and local authorities; ensuring consistency with the Party's policies, strategies and plans for socio-economic development of the country in each period; and the basic goals, targets, policies and tasks of socio-economic development approved by the National Assembly.
For issues that have been decentralized to local authorities, local authorities proactively decide, organize implementation and are responsible for the results of performing decentralized tasks.
