This afternoon, June 20, within the framework of the 7th session of the 15th National Assembly, National Assembly deputies had a group discussion on the Draft Law on Urban and Rural Planning (QHDT&NT). Speaking at the discussion session, Deputy Head of the Quang Tri Provincial National Assembly Delegation Hoang Duc Thang made many important contributions, highlighting the necessity and specific proposed amendments to this draft law.
Delegate Hoang Duc Thang emphasized that currently, the legal system on urban planning, construction planning and rural planning, although amended and supplemented, still has many overlaps and is not unified in a single law.

The adjustment of the 2009 Urban Planning Law and the 2014 Construction Law along with a number of other related laws are causing many difficulties in the application and implementation process. Therefore, the promulgation of a unified Law on Urban Planning and Urban Development is extremely necessary. This law not only helps clarify the content of urban planning and urban development but also orients and regulates the relationship between types of planning in the national planning system.
Delegate Hoang Duc Thang proposed to amend Clause 5, Article 6 as follows: Exploit and rationally use natural resources; limit the use of special-use forests, protective forests, and rice-growing land and strictly comply with legal regulations on forest protection and rice-growing land protection; minimize the filling of rivers and lakes (natural) when making urban and rural planning; use agricultural land economically and effectively for construction purposes to create development resources, economic growth, ensure social security, national defense, security and sustainable development.
According to the delegate, the current requirement is to protect rice-growing land, special-use forests and protective forests, which is extremely necessary and in accordance with current legal regulations. Rice-growing land, special-use forests and protective forests are important natural resources and need to be strictly protected to ensure sustainable development. The use of this land must be limited to the maximum to protect the environment and maintain ecological balance.
The delegate also emphasized the need to clearly define the authority to appraise environmental protection content in Article 8. Clearly defining this authority will help enhance the responsibility of competent authorities and ensure transparency and efficiency in the process of planning and environmental protection.
In the section on responsibilities for organizing the establishment of urban planning and development in Clause 3, Article 16, delegate Hoang Duc Thang proposed to add the responsibility of the provincial People's Committee in organizing the establishment of tasks and general planning projects for new urban areas expected to become provincial towns and cities. The delegate explained that clearly defining the responsibilities of the provincial People's Committee will help the urbanization and urban development process take place smoothly and be more closely managed.
In Clause 5, Article 41: Authority to approve tasks and urban and rural planning, the delegate also proposed amendments to the approval of the People's Council and the form of approval of the People's Council in the authority to approve tasks and urban and rural planning. The current regulation requires reporting to the People's Council for approval before being considered and approved by the competent state agency. According to the delegate, this needs to be adjusted to ensure flexibility and efficiency in the process of planning and approval, while reducing unnecessary administrative procedures. In addition, the delegate suggested replacing the phrase "report" with the word "submit" to the People's Council, which would be more appropriate.
Delegate Hoang Duc Thang also proposed adding a shortened detailed plan to the draft law to serve as a basis for implementation. Adding a shortened detailed plan will help the planning process become more flexible and faster, in line with practical development needs, saving time and resources, while ensuring the feasibility and effectiveness of the plan.
The Deputy Head of the Quang Tri Provincial National Assembly Delegation affirmed that the promulgation of the Law on Urban Planning and Development is not only an important legal foundation but also an effective management tool, orienting the comprehensive development of the country, contributing to improving the quality of life of the people and promoting sustainable socio-economic development.
