Former Deputy Director of the Office of Real Estate Registration of Bac Lieu City caused damage of more than 6.3 billion VND

Regarding the case of Mr. Duong Tan Thien, former Deputy Director of the Branch of the Land Registration Office (DKDD) of Bac Lieu City, who was prosecuted and temporarily detained for irresponsibility causing serious consequences, on May 28, Mr. Le Hong Quan, Director of the People's Procuracy of Bac Lieu City, said that initially, the authorities determined that Mr. Thien caused a loss to the state budget of more than 6.3 billion VND.

Mr. Duong Tan Thien (41 years old) was prosecuted and temporarily detained on May 22, while holding the position of Deputy Head of the Administrative - General Department, of the Land Registration Office, under the Department of Natural Resources and Environment of Bac Lieu.

Bac Lieu City Police issued a decision to prosecute and temporarily detain Mr. Duong Tan Thien on May 22.

Specifically, on December 2, 2018, Mr. NVT (57 years old, in Ward 5, Bac Lieu City) submitted a request to the People's Committee of Bac Lieu City to change the land use purpose (from aquaculture land to urban residential land) and a request to separate and merge plots for plot No. 262, map sheet No. 18, area 2,999 m ² , in Hamlet 3, Ward 2, Bac Lieu City.

On December 28, 2018, the Bac Lieu City Land Registration Office Branch measured 3 new plots, including: plot No. 113, map sheet No. 41, area 866.23 m ² ; plot No. 114, map sheet No. 41, area 1,024.61 m ² ; plot No. 115, map sheet No. 41, area 1,108.16 m ² .

On January 19, 2019, the Bac Lieu City Land Registration Office Branch sent a transfer of information to the Bac Lieu City Tax Department to determine financial obligations for two land plots No. 113 and 114, map sheet No. 41, with a total area of ​​1,890.84 ^m2 as "minimum residential land". The transfer was signed by Mr. Duong Tan Thien, Deputy Director of the Bac Lieu City Land Registration Office Branch.

Based on the above, Bac Lieu City Tax Department determined the land price for calculating land use fees for plots 113 and 114 to be 320,000 VND/ ^m2 . After deducting the price of other types of land before changing the land use purpose (aquaculture land) of 37,500 VND/ ^m2 , the land use fee that Mr. NVT must pay is only over 534 million VND.

However, Official Dispatch No. 1778 dated September 10, 2021 of the Department of Natural Resources and Environment of Bac Lieu determined: The location of the two plots of land 113 and 114 has a depth of less than 30 m, calculated from the planning boundary of Chau Thi Tam Street, with one side adjacent to Chau Thi Tam Street (Residential Area Ward 2, Bac Lieu City) belonging to location 1. Therefore, the total amount of money that Mr. NVT must pay is more than 6.8 billion VND. Due to the incorrect determination of the land location, the amount of money lost to the state budget is more than 6.3 billion VND.

The authorities determined that the responsibility in the above incident belonged to Mr. Duong Tan Thien, who directly identified the two plots of land No. 113 and 114 as "land with minimum location" in the information transfer form to determine financial obligations incorrectly according to Decision No. 66 dated December 24, 2014 of the People's Committee of Bac Lieu province. Mr. Thien did not properly perform his assigned tasks, was irresponsible, and did not carefully study the documents, leading to the incorrect determination of the plot location to determine financial obligations regarding land. The consequence was a loss of more than 6.3 billion VND to the state budget.

Assessing the nature and level of Duong Tan Thien's irresponsible behavior causing serious consequences, as stipulated in Clause 3, Article 260 of the Penal Code, on the afternoon of May 22, the Investigation Police Agency of Bac Lieu City Police deployed the decision to prosecute the accused and issue an order for temporary detention.
