The meeting and the 200 million gift pushed former Minister Mai Tien Dung into legal trouble

In the case that occurred at the Dai Ninh Urban Area Project for Trade, Tourism and Ecological Resort (Lam Dong Province), the Supreme People's Procuracy accused former Minister and Head of the Government Office Mai Tien Dung of the crime of Abusing position and power while performing official duties.

According to the indictment, in Conclusion 929, the Government Inspectorate pointed out many violations that occurred at the Dai Ninh project, and at the same time recommended that the Prime Minister assign the Lam Dong Provincial People's Committee to terminate the operation and reclaim land of the Dai Ninh project.

Due to his close relationship with former Deputy Inspector General of the Government Tran Van Minh - the person who signed conclusion 929, Mr. Nguyen Cao Tri (Chairman of Van Lang Investment and Education Company) met Mr. Minh and mentioned the project acquisition, asking Mr. Minh to help prevent the project from being revoked.

Mr. Minh set a condition that Tri had to ask some authorized individuals to intervene and support him in order to be "legitimately" able to handle the procedures.

On October 2, 2020, Mr. Tri signed the deposit agreement on the transfer of the Dai Ninh project.

Two days later, the tycoon brought a request to continue implementing the project of Saigon Dai Ninh Company to meet former Minister Mai Tien Dung at the Government Office headquarters.

At the meeting, Mr. Tri asked Mr. Dung to sign the petition, assigning the Department of Monitoring Inspection, Handling Complaints, Denunciations, Prevention of Corruption, Smuggling, Trade Fraud and Counterfeit Goods (Department I, Government Office) to advise and report to the Government leaders for direction, to transfer the petition of Saigon Dai Ninh to the Government Inspectorate for settlement.

Mr. Dung then wrote a note "transferring Department I" and assigned former Department Head Tran Bich Ngoc to report the proposal.

During the meeting, Mr. Tri sent a thank you gift of 200 million VND to Mr. Mai Tien Dung.

Based on the comments of former Minister Dung, the Government Office has forwarded the petition of Saigon Dai Ninh Company to the Government Inspectorate for consideration, resolution and response to the enterprise.

However, Mr. Minh still asked Tri to continue to submit a petition to the Government Office, requesting that the Government leaders issue stronger directives, in the direction of assigning the Government Inspectorate to inspect, review, and resolve the petition so that the Government Inspectorate has a basis for implementation.

On January 16, 2021, Mr. Tri made an appointment to meet and have breakfast with Mr. Mai Tien Dung at the Guest House 35 Hung Vuong (Ba Dinh, Hanoi). At this meeting, Mr. Tri presented that he was instructed by Mr. Minh to continue sending the petition, through the Government Office, to report to the Government leaders for their opinions, so that the Government Inspectorate has a basis to establish an Inspection Team to verify the petition, amend the inspection conclusion, and extend the project's progress.

Mr. Tri asked Mr. Mai Tien Dung to continue directing Department I to carry out this work. Then, Mr. Dung wrote twice "transfer Department I (early settlement) January 15" and "transfer case I" on the application dated January 12, 2021 of Saigon Dai Ninh Company, assigning Tran Bich Ngoc to propose.

As a result, the Government leaders agreed with the proposal of Department I, then the Government Office sent a document transferring the petition of Saigon Dai Ninh Company to the Government Inspectorate, with the content "The Government Inspectorate inspects, reviews, and resolves the reflections and recommendations of Saigon Dai Ninh Company...".

According to the indictment, the petition of Saigon Dai Ninh Company was resolved by the Government leaders according to the provisions of the Inspection Law. However, according to the provisions of the Inspection Law, Saigon Dai Ninh is not an inspection subject.

In addition, the content of the petition to request a delay in progress, not to revoke the project... also has no basis for resolution and re-inspection because the conclusion is that 929 has not been complained about and there are no signs of violating the law.

"The proposal was later approved by the Government leader to transfer the petition along with the direction to the Government Inspectorate to inspect and resolve according to the request and to benefit Nguyen Cao Tri, which was illegal and was the premise for a series of violations in the Government Inspectorate's establishment of a Working Group to adjust and amend the inspection conclusion, allowing the Dai Ninh Project to be extended and delayed illegally," the accusation of the People's Procuracy stated.
